Honorable Gary Safarik, Chair ~ and Members of the County Council ` - HAWAII COUNTY COUNCIL 25 Aupuni Street Hilo, HI 96720 Dear Chair Safarik and Members of the County Council: , SUBJECT: BILL NO. 163, DRAFT 4 The amended LUPAG map that the Planning Department prepared for North Kona 4 to incorporate the Planning Committee's changes has some errors because I misunderstood the action taken by the Committee with respect to the Ackerman properties and the property owners represented by Mr. Jim Bell, including William Paris. The action of the Planning Committee was to grant their request that some of their property not be placed into Important Agricultural Lands on the LUPAG map, but be retained in the current categories (Orchards or Extensive Agriculture.) The specific request of Mr. Bell's clients, as contained in their Nov. 21, 2003 letter, was that the area below the 1000' elevation not be classed as Important Ag. The Ackerman letter of December 20, 2004 objected to the classification as Important Ag for "our property below the old railroad, or the current new Hokuli'a bypass highway." The North Kona 4 map that we sent to the Council on January 11, 2005 changed portions of the Bell clients' land that is above 1000' in elevation, and also changed some of the Ackerman property that is above the old railroad. The error also affects the South Kona 1 map, because there is an overlapping area between the two maps, and the island maps. I have enclosed a corrected version of the North Kona 4 map, South Kona 1 map, and island maps, that conforms to the specific action of the Planning Committee.
