Subject: Ordinance Amending Chapter 19-60, Commercial Agricultural Use Dedication
Ordinance No. 04-143 was enacted on December 8, 2004 that was after the September 1 deadline
for filing of commercial agricultural use dedications. Because of this, many properties in
agricultural use will not be able to receive the benefit of the commercial agricultural use
dedication until the 2006-2007 tax year.
Enclosed is an ordinance amending Chapter 19-60, Commercial Agricultural Use Dedication, of
the Hawaii County Code to allow for none-time extension for filing of commercial agricultural
use dedication for the 2005-2006 tax year.
Due to the importance and urgency of this ordinance, we ask that action by the Finance
Committee be waived and that it be sent directly to the full Council.

RE: (Bill No. 27 An Ordinance amending Chapter 19, Article 8, Section 19-60, of
the Hawaii County Code 1983 (1995 Edition), relating to commercial agricultural use
dedication.)
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
