SUBJECT: SIGN PERMIT APPLICATION

This is in response to your letter dated July 14, 1997 regazding the subject
application:
A. Flags may be considered not to be siens. A sign as defined under
the Hawaii County Code includes any announcement, declazation,
demonstration, display, illustration or insignia, used to advertise or
promote the interests of any person when it is placed out of doors on
real property or buildings or structures on real property or buildings
in view of the general public. Flags of nations and states aze not
considered signs because they do not advertise or promote the interest
of any person, but rather they symbolize the unity and ideals of
people. When used to promote or advertise the interests of people a
flag is considered a sign.
B. When flaw are not considered siens, there is no limit on the
number of siens allowed.
C. International Motors could have un to two siens ner street
frontaee. Section 3-25 sets the maximum number of signs allowed
for each business at two signs per street frontage. Of the two signs
allowed, each one must conform to one of the types of sign permitted
under the district classification. For example, in a commercial district
with two street frontages, Street "A" could have a ground sign and
wall sign. and Street "B" could have a ground sign and a root sign.

D. Violations of the Bien reeulation can not be allowed. To address
this last item, we agree that enforcement has been sporadic at best.
Signs that are temporary in nature are not easily "policed" and do
pose problems in enforcement, however, any violation can not be
allowed to go uncorrected. All inspectors have been alerted to notify
all auto dealers with violations of the sign ordinance.
