RESOLUTION NO. 41 ~~5
RESOLUTION EXTINGUISHNG UTILITY EASEMENT FOR THE MT. VIEW-`OLA`A
WATER SYSTEM.
WHEREAS, the Department of Water Supply no longer requires the use of a portion of the
Mt. View-'Ola`a Water System utility easement existing on Tax Map Keys: (3)1-8-005:018,
(3)1-8-005:125, and (3) I -8-005:145 due to the relocation of the pipes in that service system; and
WHEREAS, the Department of Water Supply originally acquired this easement by a Grant of
Easement recorded at Liber 2772, Page 82, from then Olaa Sugar Company, Limited on a single parcel,
Tax Map Key: (3)1-8-005:018, for the purpose of supplying water to the public; and
WHEREAS, Olaa Sugar Company, Limited evolved to Puna Sugar Company, Limited, who then
subdivided the parcel with the easement into two additional parcels; and
WHEREAS, the three subdivided parcels are now under title to:

Rachel Birch Kailiawa

WHEREAS, the water supply pipes on this easement are buried underground and removal of the
pipes may cause disturbance to both the property owners and their lands, and therefore the Department
of Water Supply intends to abandon the pipes in place; and
WHEREAS, the above-cited landowners will assume full control and liability over the lands and
underground pipes of this easement; and
W~IEREAS, pursuant to the stated terms of the easement, upon ceasing of permanent use of the
easement for supplying water to the public, the easement or right-of--way shall revert back to the grantor,
or its successors and assigns.
NOV6', TIIEREFORE, BE IT RESOLVED BY TIIE COUNCIL OF THE COUNTY OF
IIAd6'A.I`I, that the easement on Tax Map Keys: (3)1-8-005:018, (3 )1-8-005:125, and (3 )1-8-005:145,
recorded at Liber 2772, Page 82 shall be extinguished and such extinguishment shall be recorded with
the Bureau of Conveyances.
BE IT FURT~IER RESOLVED that copies of this resolution be forwarded to (1) Milton Pavao,
Manager of the Department of Water Supply; (2) William Takaba, Director of Finance; (3) Andrew
Kanilao Kailiawa and Rachel Birch Kailiawa, 1067 Mililani Street, Hilo, Hawaii 96720; (4) Paul
Richard Harder, General Delivery, Mt. View, Hawaii 96771.
