No. 42.74 Aloha Council Members, * The County of Hawaii is currently updating the General Plan, as part of the periodic 1"General Plan Revision Program." The General Plan Revision Program includes updating the Land Use Planning Allocation Guide ("LUPAG") Map. The Hawaii County Charter Section 6-4.2 states that the Planning Director shall "Prepare a general plan, implementation plans and any amendments thereto in accordance with section 3-15." * The Office of Planning describes their mission on their website as: Improving overall efficiency and effectiveness in government decision-making through education, facilitation, and coordination of GIS mapping technologies. * In 1999 the Hawaii State Office of Planning scanned the LUPAG Map adopted by Ordinance No. 89-142 (1989 General Plan), hereafter refered to as "1989 Base Map," at a compatible scale with current GIS database for the Planning Department to use as a base map for the General Plan Revision Program. The Planning Department has access to other standard state GIS databases such as Tax Map Keys, County Zoning, and Land Use Commission designations. * The Planning Director provides written direction to the Planning Department's GIS draftsman for all drafting work. As part of the General Plan Revision Program the Planning Director made specific revisions to the 1989 Base Map. The Planning Department's GIS draftsman implemented all revisions by drawing on top of the 1989 Base Map as a guide. * The 1989 Base Map was amended under the direction of the former Planning Director to reflect the General Plan Amendment Ordinances adopted by the County Council after Ordinance No. 89-142 (1989 General Plan), hereafter refered to as "Current LUPAG Map". For some reason there was a drafting error made when adding Ordinance 97-34, which amended the LUPAG map to change a 25-acre site within the current Hokulia project from "Orchards" Comm. No. y'Z•'7g 1 Ref. To: ~+e~ Ref. Date to "Resort." Ordinance 97-35, A State Land Use Boundary Amendment which reclassified a 15 acre area within the 25 acre "Resort" land use element site was improperly added onto the 1989 Base Map. Ordinance 97-35 map (SLU Boundary Amendment Map)was substituted for Ordinance 97-34 map (General Plan Amendment map) misrepresenting Hokulia's 25 acre "Resort" land use element. This map was displayed on the County's website by the Data Systems Department, hereafter refered to as the "Current LUPAG Map." * The Planning Department and legislative Auditor's office prepared and submitted General Plan Revision Program updates to the Hawaii County Data Systems Department. The Data Systems Department put the updates on the County's website for public review the same day that they received the updates. * Prior to January 4, 2005 three drafts of the General Plan were created and displayed on the County's website during the course of the General Plan Review Program. The process is described in the November 9, 2009 Memo from former Planning Committee Chair- Leningrad Elarionoff. (Exhibit 1). LUPAG Maps for Draft N0. 1, Draft N0. 2, and Draft N0. 3 all contain the same drafting error made on the Current LUPAG Map. Ordinance 97-35 map (SLU Boundary Amendment Map)was substituted for Ordinance 97-34 map (General Plan Amendment map) misrepresenting Hokulia's 25 acre "Resort" land use element. * January 4, 2005 The County Council Planning Committee held a public hearing to review Bill No. 163 [Draft 1]; Bill No. 163 Draft 2; and Bill No. 163 Draft 3. These Bills proposed numerous amendments to the 1989 General Plan as part of the current comprehensive review. See January 4, 2005 Agenda (Exhibit 2) * The The County Council Planning Committee voted and opposed adoption of Bill No. 163 Draft 3, and Bill No. 163 Draft 2. * The County Council Planning Committee made several floor amendments to Bill No. 163 [Draft 1] which are listed in the January 11, 2005 Memo from Planning Committeee Chairperson- Councilman Angel Pelago. (Exhibit 3). * Bill No. 163 [Draft 1] became Bill No. 163 Draft 4 as a result of the January 4, 2005 floor amendments. * LUPAG Map Draft No. 9 amended LUPAG Map Draft No. 1 and was intended to change back Hokulia's land use elements to the way they were before Draft No.l was created. The Planning Department's draftsman was on vacation when the Draft No. 1 LUPAG Map was changed to Draft 4 and another drafting error occured (See Draft No. 9 Lupag Map detail, Exhibit 4). I brought this to the Planning Department's attention (see note, Exhibit 5). 2 *Draft No. 4 was amended by floor amendments on January 21, 2005. LUPAG Map Draft No. 5 amended LUPAG Map No. 4 and was intended to correct the drafting error misrepresenting the Hokulia "Resort" land use element. *There was another drafting error made in the creation of LUPAG Map Draft No. 5. Ordinance 97-34 map was again substituted for Hokulia's "Resort" land use element. * Draft No. 5 General Plan was late in going up on the County's website and did not include the LUPAG Map Draft No. 5. There may be additional drafting errors that could have been caught had the LUPAG Map No. 5 been available for review. The General Plan Book format is at a scale that no one can review LUPAG Map Draft No. 5.
