Re: Resolution for an inter-governmental agreement with the City and County of Honolulu
The real property administrations of the four (4) counties realize that they have common
concerns and need to support each other. It was determined that benefits could be
realized by working together to share resources. As a result, through a cost sharing
agreement with the City and County of Hawaii, certain real property services will be
provided to support our county's real property tax program.
Enclosed is a resolution authorizing the Mayor to enter into amulti-year
intergovernmental agreement with the City and County of Honolulu for real property tax
program support services as well as authorizing the payment of funds for more than one
fiscal year for this agreement.

A. REQUEST:
Requesting a resolution authorizing the Mayor to enter into an inter-government agreement with the City and
County of Honolulu for real property tax program support services. The term of the agreement will be thirty-
six (36) months commencing July 1, 2004 and ending June 30, 2007. The agreement may be extended for
two additional one-year terms upon agreement of the parties.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The real property administrators statewide realize that the counties have common concerns and need to
support each other. Many months of discussion resulted in an intergovernmental agreement. This is a cost
sharing agreement in which the City will provide certain services to support our county's real property tax
program. The scope of services will include technical services, support and training to areas of statewide
concern, common to all counties and provide documents in editable electronic formats.

A G R E E M E N T
THIS AGREEMENT, made and entered into this day
of 2004, by and between the CITY AND COUNTY
OF HONOLULU, hereinafter called the "CITY," and the COUNTY OF
HAWAII, hereinafter called the "COUNTY."
WITNESSETH THAT:
WHEREAS, the CITY and the COUNTY agree under this cost
sharing agreement that the CITY shall provide certain services to
support the COUNTY's real property tax program under the terms
and conditions described herein;
NOW THEREFORE, the parties hereto agree as follows:
1. SCOPE OF SERVICES. The CITY shall provide the COUNTY
with technical services, including the development and
maintenance of an appraisal manual; the development and
maintenance of a building classification manual; training and
technical support for valuation methodology, including market
modeling, cost, and reconciliation; and technical support for
standards, procedures, and reports, including any non-appraisal
manuals, relating to system-wide quality controls. Unless
otherwise provided for in this agreement, the aforementioned
services shall be limited to areas of statewide concern, common
to all counties and provided in editable electronic formats. The

CITY shall furnish and provide additional services as may be
requested by the COUNTY and agreed to by the CITY, said services
being in addition to services described hereinbefore. The time
for CITY's performance of services shall be as agreed upon
between the CITY and the COUNTY.
2. COMPENSATION AND PAYMENT. The COUNTY shall pay the
CITY on or before the 20th day after the close of each of the
four (4) calendar quarters, the sum of $23,500 - 4 = $5,875, and
the COUNTY agrees that said actual costs shall be the Contract
Price. The Contract Price shall be adjusted annually for any
changes in labor costs incurred by the City. Full payment by the
COUNTY of the Contract Price shall be made within twelve (12)
months of the close of the term of this AGREEMENT. The CITY
shall provide the COUNTY, upon the request of the COUNTY, a
detailed accounting to show the computation of its charges.
3. COMPENSATION AND PAYMENT FOR ADDITIONAL SERVICES. The
price for any additional services provided under Paragraph 1,
SCOPE OF SERVICES, such as educational offerings, including IAAO
courses and in-house classes, shall be the actual costs thereof.
The billing for such additional services shall be separately
submitted by the CITY to the COUNTY and shall contain an
accounting showing the computation of the price. Full payment by

the COUNTY for additional services provided by the CITY under
said Paragraph 1, shall be made within thirty (30) days after the
date of billing for such services.
4. INDEMNIFICATION. The COUNTY shall indemnify and hold
harmless the CITY against any loss or damage arising or
proximately resulting from the COUNTY'S negligent performance of
the covenants, terms, and conditions of the agreement herein
except where such loss or damage arises or proximately results
from the negligence of the CITY.
5. TERM OF THE AGREEMENT. The term of this AGREEMENT
shall be effective for a period of thirty-six (36) months,
commencing July 1, 2004 and ending June 30, 2007. This AGREEMENT
may be terminated by either party provided that six (6) months
prior written notice is given to the other party. This Agreement
may be extended for two one-year terms upon agreement of the
parties. Compensation for the extended terms shall be as stated
in section 2 above.
6. DESIGNATION OF LIAISON OFFICER. The parties hereto
shall, upon execution of this AGREEMENT or immediately
thereafter, each designate a representative to act as liaison
officer for the purpose of coordinating the work required to be
performed pursuant to this AGREEMENT. Additionally, the

designated liaisons shall form an advisory committee to provide
input in scheduling core services and any additional services for
each year.
IN WITNESS WHEREOF, the parties hereto have caused this
AGREEMENT to be executed as of the date first written above.
