No. 8/Bill No. 2 <br /> <br /> PLACE: Council Chambers <br /> <br /> T[ME: ]:30 p.m. <br /> <br /> Council Chair Safarik and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Bill No. 2, reports as follows: <br /> Bill No. 2, transmitted by Mayor Han•y Kim via Communication No. 8, dated November 16, <br /> <br /> 2004, amends Section 25-8-22 (Puna District Zone Map), Article 8, Chapter 25 of the Hawai' i <br /> <br /> County Code, by changing the District Classification from Open (O) to Family Agriculture <br /> <br /> (FA-2a) at Tax Map Key 1-4-73:1 in Kapoho, Puna, Hawaii. <br /> Fay Machielse and Mark Dziatko requested this change for approximately 4.861 acres at the <br /> <br /> eastern end of Milani Rd. and approximately 0.6 miles from the Milani Rd. Kapoho-Beach Lots <br /> Road intersection, Vacationland Hawaii Subdivision, Unit II, Kapoho, Puna, Hawaii. <br /> <br /> The applicants are requesting the change in order to construct a 2-bedroom dwelling for their <br /> <br /> principal residence on approximately one acre of the site, and plant a small, non-commercial <br /> <br /> orchard. They have no plans to subdivide at this time. <br /> <br /> Communication No. 8 reports that the Hawaii County Planning Commission considered the <br /> <br /> above request and concurred with the Planning Director's favorable recommendation on this <br /> <br /> matter. <br /> fhe change in zoning request conforms to the goals of the General Plan economic and land use <br /> elements, and to the General Plan Land Use Pattern Allocation Guide (LUPAG) Map. The <br /> change is consistent with the existing agricultural zoning of properties within the Vacationland <br /> Hawaii Subdivision. <br /> Conditions of approval require that the applicants notify the Department of Land and Natural <br /> Resources Historic Preservation Division (DLNR-HPD) should any unidentified sites or remains <br /> he encountered, and then proceed only upon an archaeological clearance from the DLNR-HPD. <br /> Your Committee concurs with the Planning Commission and the Planning Director's favorable <br /> recommendation on this matter. <br /> <br />
