Your Committee on Planning, to which was referred Bill No. 21, reports as follows:
Bill No.21, transmitted by Mayor Harry Kim via Communication No. 64, dated December 21,
2004, amends Section 25-8-3 (North Kona Zone Map), Article 8, Chapter 25 of the Hawai `i
County Code, by changing the District Classification from Agricultural 1-Acre (A-1 a) to Single
Family Residential -15,000 square feet (RS-15) at Tax Map Key 7-4-4:80-83 in Kealakehe
Fomestead Lots, North Kona, Hawaii.
Ho`awe LLC requested this change for approximately 4.006 acres at the western end of Pamahoa
Place, approximately 600 feet from the Palani Road-Pamahoa Place intersection, Pamahoa
Estates Subdivision, Kealakehe Homestead Lots, North Kona, Hawaii.
The applicants requested the change in order to create four additional, single family 15,000
square feet residential lots.
Communication No. 64 reports the Hawaii County Planning Commission considered the above
request and did not agree with the Planning Director's favorable recommendation on this matter.
The Planning Commission reports the zoning change would not provide affordable housing and
it would change the character of the neighborhood. The Planning Commission also reported
traffic concerns from the Department of Public Works.
The Planning Commission reported that during their hearing a motion was made to send an
unfavorable recommendation to the County Council. Four members voted in favor of the motion
and one against. Because five votes are needed for the Planning Commission to take action, the
four to one vote constitutes a "no action" by the Planning Commission. The "no action" itself
constitutes an unfavorable recommendation.
Your Committee on Planning is concerned that the proposed change in zoning will exacerbate
traffic conditions while doing little to provide affordable housing in Kona.

A motion to approve this measure received 7 no votes. According to Council rules, 5 aye votes
are needed to pass a measure. As a result, your Committee on Planning forwards Bill 21 to the
Council with a negative recommendation.
