Your Committee on Finance, to which was referred Communication No. 62, reports as follows:
Communication No. 62, transmitted by Corporation Counsel Lincoln S.T. Ashida, dated
January 6, 2005, authorizes the extension of the existing special counsel contract.
The Safety Division wishes to extend this special counsel contract with Pinao & Ono, and
increase the contract amount by 30,000, for a new contract total of $260,000.
Worker's compensation is a very specialized area of the law. For an effective valuation,
prosecution and defense of these cases, they should be performed by attorneys specialized in this
area, since a significant portion of this body of law is comprised of arbitration and hearing
decisions.
Pursuant to Article VI, Chapter 2, Section 6-2.5 of the Hawaii County Charter, the Council may,
by two-thirds vote of its entire membership, authorize the employment of special counsel for any
special matter presenting a real necessity for such employment. Any such authorization shall
specify the compensation, if any, to be paid for said services.
Your Committee on Finance recommends the acceptance to extend the existing special counsel
contract.
