FROM: Bob Jacobson
RE: Bill 4, Draft 5 -Relating to Animals
Attached for your review and transmittal is Draft 5 of Bill 4. Draft 5 includes the following
changes to Draft 4:
1. It replaces the term '`eleemosynary" with "nonprofit organization that is exempt
from taxation pursuant to section 501(c) of the Internal Revenue Code, 26 U.S.C.,
as amended."
2. It deletes "honeybees" from the definition of animals and deletes the last sentence
in the current definition of animals. It also adds "farm animals and poultry" to the
current definition.
3. It deletes references to "small" domesticated animals.
4. It replaces references to "destruction of,' and "destroying" dogs with broader
terms "disposal" and "disposing of."
5. It adds "treating" dogs as one of the purposes of a pound.
6. It provides that the County's definition of "cruelty" supplements the definition
found in Hawaii Revised Statutes.
7. It reduces $2,000 fines to $1,000 pursuant to the Hawaii County Charter, Article
XIII, sectionl3-ll.

8. It clarifies that all fees go into the special fund and deletes language about fines
being paid to the County.
9. It makes a number of technical changes.
Please have this item referred to the Council for consideration.
