Dear Mr. Safarik,
I was present at the County Council meeting of the Animal Control Task Force in
Kona on Monday,Feb. 7. to discuss issues about the Animal Cruelty Bill.
I presented the two enclosed ideas to consider amending to the bill. I gave copies
to ,Nancy Zom, chair of the Animal Control Task Force committee. I am sending them to
Mitchell Roth, Bob Jacobson, and Virginia Isbell.

Subject: Amendment to the Animal Control Bill
Please consider a law limiting the number of dogs per household to 2. Our city is too
crowded in most neighborhoods to accommodate more than two dogs without annoying
others, causing stress, and lowering their neighbors quality of Irfe. It does not make for
friendly relations in a neighborhood to have multiple dogs who bark ,howl, bay, cry
continually or incessantly. It is not healthful to be around dogs who are allowed to defecate
day after day on their back yards or commit any nuisance on any part of their own home
adjacent to others so close to them.
People who have acreage, and have room for farm animals are different than those of us
who live in such close quarters. It is very logical to limit pets to 2 at a time within the city
limits on small lots.. Many home assoaations limit animals to make their neighborhoods
safe and serene. Kailua-Kona is building so many new homes every day that It makes
sense for all of tthe people within in our aty limits to know that the law only allows two pets
per household.

Subject: A request for an amendment to the Animal Code, Chapter 4 to be considered at
the next hearing by the County council.
Please move the existing Hawaii County code, REFUSE, Chapter 20 ,ARTICLE 1,
LITTERING ,Section 20-5 LITTER PROHIBITED ON OCCUPIED PRIVATE
PROPERTY, to the Hawaii County code ,ANIMALS, CHAPTER 4.
It would then be directly specific to some problems with neighbors who own multiple
dogs who defecate in their yards and is not ever picked up, and how it affects the neighbors
within 500 feet of the lot in a crowded city neighborhood. It is a health hazard and
contaminates the soil.
The reason for this request is a scenario at hand:
SIX (6) medium to large dogs next door.
Feces left in backyard for 6 months without being picked up.
Neighbors have 20 feet between our lanais.
The smell is overpowering and causes great distress.
Neighbors feel sick inside their own bedroom and living room and outside on the
deck or in their own yard..
I, am a concerned new citizen of Kona, have read and will quote parts of the present
Hawaii County code.
Chapter 20: Refuse
Section 20-1 Definitions:
Article 2. "LITTER" means any waste material including, but not limited to, any animal
and vegetable wastes"............
Section 20-5 states: LITTER prohibited on occupied private property.
"NO PERSON SHALL THROW OR DEPOSIT LITTER ON ANY OCCUPIED
PRIVATE PROPERTY ,WHETHER OWNED BY THAT PERSON OR NOT........OR
UPON ANY PRIVATE PROPERTY"
SECTION 20-7 SUMMONS OR CITATION FOR VIOLATION
A police officer shall use a form of summons or citation provided by the County in
citing a violator of any provision of this article.
SECTION 20-8 PENALTY
Any person who violates the provisions of this article shall, upon conviction, be
sentenced to pay a fine of not less than $250.00, and not more than $1,000 for each
offense
