reports as follows:
Resolution 34-05, transmitted via Communication No. 74, dated January 5. 2005, from Director of Pinaucc
William Takaba, authorizes the granting of an easement for a retaining wall to Frances Rae McClure, 'trustee.
and .lobo Q. McClure, Jr. at Kona Palisades. Unit I, Kalaoa 5°i ,North Kona, Hawaii. TMK: (3) 7-3-31:46.
l~he fair market value of the retaining wall easement with an area of 28 square feel is $625 A0, according W an
independent appraiser.
Councilmcmber K. Angel Pilago was troubled by people encroaching on public lands and opposed granting
casements to people who encroach on public properly. Councilmcmber Virginia Isbell expressed concern
over encroachments on public lands that were becoming a habitual practice. She suggested that people
(contractors, surveyors, and landowners) who encroach on public lands should be held accountable by facing
penalties. such as lines and/or loss of licenses for a period of time. Councilmember Dr. Fred I lolschuh
commented that the County needs to support efforts to make sure that this type of issue does not occur in the
fuuirc.
Mr. 13udd~ Norwood, an agent for the seller and Realtor with Maryl Realty, said that a mistake was made
years ago. and a variance application was filed with the Planning Department in 1996. He further staled that
the Planning Department approval was subject to the encroachment being authorired by the Department of
Public Works and the Council.
Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose and intent of
Resolution 34-OS and recommends its adoption.
