Thiriag the Council Hearing February 16, 2005, regarding the above-captioned development,
there was much discussion regarding "Public Access" and an "Agreemeul" especially os these
two subjects impact on public access and fishing rights.
1 am unable to locate any "Agreement" between Continental Pacific, LLC and Hawaii Coumy.
Ptea.4e send me a copy prior to the subject matter coming before the Council's Second Reading.
Also, regarding Chapter 34, Public Access Code - Has the azea on the Point been subdivided and
approved for building with a specific easement for public access? If so, would you please also
send me a copy of that document prior to the Second Reading.
As I read Chapter 34, Section 34-4 (a) "A subdivider or developer of a multiply,-family
development shall, as a condition precedent to final approval of a subdivision or issuance of a
building pc~utit for a multiplo family development, dedicate land by right-of--way in fee or
easement for public access from a public highway or public street to the following:
Public shoreline areas and the land below the shoreline....
(b) The location of public shoreline and moumain areas and existing shorcine, coastal and
public mountain trails shall be determined by the director in consultation with the DLNR and
county department of parks and recreation and shall be established by rule ptirsuarit to
chapter 9t, HRS. Were hearings held in this regard?
This section of the County Code gocs into more detail, including maps depicting the public-
owaed wrens and the approximate location of existing public trails, etc
Section (f) refers to development agreeatents which also refer to requirements for dedication of
public access to the shoreline.
