RE: Bill 4, Draft 5 -Relating to Animals
1 will be proposing the following amendments (which are bolded) to Draft 5:
1. To allow trained volunteers to supplement enforcement efforts
Section 4-1. Definitions.
~ "Animal control officer" means any employee or trained volunteer of acounty-
contracted animal control services provider or the Hawaii County Police
Department who is authorized to carry out and enforce the provisions of this chapter.
Such individual shall also be known as and may bear the title of "enforcement
officer".
Section 4-5. Enforcement by humane officer.
"The humane society or animal care center with whom the County has contracted for
services may designate its employees who possess qualifications and training satisfactory
to the County to serve as enforcement officers to carry out the provisions of this article,
chapter 143, Hawaii Revised Statutes, and other provisions of this chapter which
expressly authorize such enforcement officers to take specific action by ordinance. The
humane society or animal care center with which the County has contracted for
enforcement services is authorized to train and designate volunteers as enforcement
officers.
2. To maintain a consistent definition of leash

~ '`Stray" means:
(1) an unlicensed dog or dog without a license for the current year;
(2) any dog on the premises of a person other than the owner of the dog, without the
consent of an occupant of such premises;
(3) any dog on a roadway on public or private school grounds, or in any
other public place, except when under the control of the owner by leash, cord, chain
or other similar means of physical restraint, provided that such leash, cord, chain or
other means is not more than six ~eigltt] feet in length, and provided further that this
provision shall not be construed to permit that which is prohibited by any other law;
or
(4) a cat or other [sttiall~ domesticated anima] wandering or running at large, or found
upon any roadway, public place or found not upon the lands of the owner or not
under the charge or control of one in possession.
3. To allow for a smaller licensing fee increase for microchipped dogs
Section 4-1 . Definitions.
O "Microchip" means a tiny computer chip about the size of a grain of rice, which contains
identification data that is accessible to a humane society or animal care center
Section 4-12. Tees.
(a) The following fees arc hereby established as biennial license fees for the privilege of
owning, harboring or keeping of dogs in the County:

Section 4-13. Proof of sterilization and microchippinK.
Any person seeking to have ~his~ a dog licensed at the sterilized dog rate must present a
certificate from a licensed veterinarian ~ ' ]showing the
description, age, and breed of the dog and certifying its sterilization. Any Person seeking to
have a dog licensed at the mircochin rate must present a certificate from a humane society,
animal care center or a licensed veterinarian showing the description, a¢e and breed of the
doa and certifying that it a microchip has been implanted in the dog.
4. To fix a typo
Section 4-14. Impoundment of animals.
(a) if any animal, except dogs and cats, trespasses, roams, strays or grazes upon any public
lands, private lands of another, or u on an roadwa m the County, any

police officer or enforcement officer may seize and impound such animal for such period of
time as may be deemed necessary; provided that reasonable attempts have first been made to
notify the owner or keeper of the animal to remove the animal.
~(dj~ ~If reasonable attempts to notify the owner or keeper of the animal are unsuccessful, if
the owner or keeper is unknown, or the owner or keeper refuses or fails to remove the
animal after notice, the animal may be seized and impounded by the police or any officer.
"fhe owner or keeper of the animal shall pay not less than [~5] $25 for each animal that is
seized and impounded plus all additional costs incurred in the removal and transportation of
the animal, and all costs for the feeding and care of each animal, including, but not limited
to bona fide veterinary expenses. If any damage is done by the animals, the owner thereof
shall pay to the proper claimant the full amount of damage or loss occasioned by the
straying of the animals.
5. To clarify
Section 4-29. Leash requirement.
No person shall bring or permit any dog in any roadway, County park, public or private
school ground, [ems}airport, or in any other public place unless it is held under control by a
suitable leash, not more than six feet long; provided, however, that dogs even under control
by a suitable leash shall not he allowed in any County beach park. [T''^°~
(b) Licensed fhtFetmgl dogs, when accompanied by and under the control of their owner, while
lawfully on public or private huntinggrounds and engaged in the act of hunting, will not be
subject to the leash requirements, however, at all other times, the dogs are subject to the
requirements of this section.
(c) This section shall not apply to "Seeing, Eve" dogs or other dogs necessarily used for the
benefit of handicapped persons or to dogs used for pumoses of law enforcement by law
enforcement agencies of the Federal, State or County governments.
(d) [t shall be unlawful for the owner of any dog, whether the doe is licensed or not, to permit
such dog to become a stray.
