Re: (Bill 4, ra 5) AN ORDINANCE AMENDING CHAPTER 4 OF THE HAWAII COlJNTY
CODE 1983 (1995 EDITION) RELATING TO ANIMALS
1 am Catherine Killam. I testified at the last hearing regarding the previous version of this Bill. I am grate-
ful that some of my suggestions were added. Thank you. I would also like to commend the Council for the
addition of the Spay Neuter Special Fund. I have several suggestions regazding the spay-Neuter Special
Fund.
Please consider having the funds disbursable by way of grants to any animal care center/ humane society
operating in the County of Hawaii. This would allow more opportunities and ways of increasing spay/
neuters which could target problem areas, i.e., dumps, beaches and specific communities. A special Fund
Committee could review grant applications and make recommendations to the Department of Finance.
I have attached a sample Request for Proposals form as a possible model.
I have also attached a possible model regarding the Fund Committee.
I again would like to reiterate my concern about the animal cruelty fine.
The minimum fine for auimal cruelty should be higher than those of auimal nuisance sec-
tions.
Cruelty is a human action and the seriousness should reflect it in a higher minimum fine. Abandon-
ing an animal has created many of the problems that we are now dealing with. Please raise the minimum
fine from $75.00 to $150.00 for Sections 4-17 Cruelty to animals, including dogs and cats and Section 4-
27Injuring or poisoning dogs.
Pease also add "cats" to Injuring or poisoning dogs, Its absence implies that it is okay to poi-
son or injure cats.
In the future please also consider a required holding period for cats similar to dogs. As it is cur-
rently cats can be immediately euthanized when turned in to the Hawaii Island Humane Society.

Section 4-36 Spay-neuter special fund.
(d) The Department of Finance shall divide the funds by way of a grant application
process. Any animal caze center/humane society operating in the County of Hawaii may
submit aSpay/Neuter Special Fund Request for Proposals annually. In determining how
the funds shall be expended, the Department of Finance shall consider the
recommendations of the Fund Committee, as defined in (g) below.
(g) For purposes of this section, the "Fund Committee" shall mean a committee
comprised of the following individuals:
(1) A representative of the Department of Finance.
(2) A representative from any of the Animal Care Centers/I-lumane Societies operating in
the County of Hawaii.
(3) A licensed veterinarian.
The Fund Committee shall meet as often as is necessary at times and in locations
specified by the chairperson. The Fund Committee shall review Request for Proposals
and issue recommendations to the Department of Finance for funds from the Spay Neuter
Special Fund. Three members shall comprise a quorum and actions by the committee
may only be taken by majority vote of those members present. The members shall receive
no compensation for their services.

Grant Guidelines and Criteria
INTRODUCTION
The Spa}' Neuter Special Fund was established in 2005 under Ordinance No.
Amending Chapter 4 ofthe Hawai'I County Code 1983 (1995 Edition).
The Spa}' Neuter Special Fund is funded from the proceeds from all licensing fees
pursuant to Section 4-12 of Chapter 4 and all impoundments and kennel fees pursuant to
Section 4-20 of Chapter 4 as well as any Council appropriations for the purposes of
Section 4-36 and any grants and private contributions intended for the purposes of the
Spay-Neuter Special Fund.
The Fund exists to reduce animal overpopulation in the County of Hawaii and seeks to
accomplish this goal by providing funds to non-profit organizations within the County of
Hawaii that provide free or low-cost spay/neuter services.
ELIGIBILITY
Applicants must be a Hawaii non-profit 501(c)3 humane organization working within the
community to assist companion animals
DEADLINE
Proposals must be postmarked no later than March I S of the current year. The original
and six (6) copies must be included.

CONTRACT TERMS AND CONDITIONS
The maximum term of an award is one }'ear. Funding for the grants is subject to the
proceeds from all licensing fees pursuant to Section 4-12 and all impoundments and
kennel fees pursuant to Section 4-20; Council appropriations for the purposes of Section
4-36 and any grants and private contributions intended for the purposes of the Spay-
Neuter Special Fund.
If awarded a grant from the Department of Finance, the grantee will be expected to sign
an agreement/letter of understanding abiding by certain terms and conditions, including:
A final report detailing expenditure of funds and project results is required within 60
days of project completion. We reserve the right to request documentation such as
receipts.
' In all printed matter, press releases, and other local announcement regarding this
project, the grantees shall acknowledge the funding support provided by the Spay-Neuter
Special Fund.
G Monies not used for the purpose intended shall be returned to the Spay-Neuter Special
Fund administered and managed by the Department of Finance.
~l Statistical Follow Up Questionnaire will be sent and required to be completed and
returned within 60 days.
PROPOSAL EVALUATION PROCESS
The Spa}' Neuter Specia] Fund Committee will screen and evaluate proposals and notify
applicants by April 15th. Any proposal that does not have the required information or
documentation may be disqualified. The criteria that will be used to evaluate proposals
include:
Goal/Scope: The proposal demonstrates how it will benefit specific animals and reach its
audience, both animals and people. Proposals that focus on feral cats should specify how
attempts will be made to impact the entire colony/population/community.
Need: The proposal conveys a good understanding of a particular need in the targeted
area and adequately addressed how the proposed project addresses it.
Project design: The project iswell-thought out and presents a clear method/strategy to
reduce pet overpopulation. Ability to define and quantify pet overpopulation problem in
your community.
Collaboration: The proposal takes into consideration any possible collaboration (with
animal shelters, veterinarians, educational outreach providers) that can effectively help
reach the proposal's goal.
Assessment: What measurable criteria will be used to determine if your organization
reached its objectives.
