Your Committee on Finance, to which was referred Bill No. 37, reports as follows:
Bill No. 37, transmitted by Deputy Corporation Counsel Patricia K. O'Toole, via
Communication No. 116, dated February 16, 2005, amends Chapter 2, Article 15, subsection
2-911(d), Hawaii County Code L983 (1995 Edition), relating to financial disclosure forms.
The purpose of this measure is to eliminate the option of filing a short form financial disclosure
form. The board of ethics requested this change to the County's Code of Ethics.
Communication No. 1 16.1 ti-om R.N. Williams,chairman of the board of ethics, dated
February 25, 2005, states that the board reviews the annual financial disclosure form to ensure
adherence to ethical standards. The board's concern is that the short form opens the door to
unwitting, or perhaps deliberate, oversights on the behalf of filers. The use of short forms also
creates an unruly and burdensome administrative problem in the filing, correlation, and review of
these forms, together with the associated long forms. After much discussion and thoughtful
contemplation, the board unanimously decided to pursue a change in the ordinance to eliminate
the short form altogether, thereby requiring the annual tiling of a full disclosure statement (long
form).
Your Committee on Finance is in accord with the purpose and intent of Bill No. 37 and
recommends it pass first reading.
