Dear Chairman Safarik and Council Members:
RE: Request for Waiver of Committee Consideration for Nominees
to the Hawaii County Board of Ethics
The Hawaii County Office of the Corporation Counsel respectfully
requests, pursuant to Rule 4(2)(g) of the Rules of Procedure of the Council of the
County of Hawaii, that the nominees for the Hawaii County Board of Ethics,
identified in the attached communication from Mayor Harry Kim, be waived to the
Council agenda for immediate consideration and confirmation.
This request is made for the reason that the five-member Board of Ethics
will be left with only two members after March 31, 2005, and at least one
additional member is required for a quorum.
The Corporation Counsel has a request pending with the Board of Ethics
for an informal advisory opinion concerning a matter related to the Hawaii Rules
of Professional Conduct. Our office has arranged to have a deputy corporation
counsel from Maui County attend the April 12, 2005, meeting of the board, in
order to provide them legal representation, due to a potential conflict of interest
with the attorneys in our office.
Unless this matter is waived to the full Council and at least one nominee is
confirmed, the meeting of April 12, 2005, will need to be cancelled.
