Inouye, the Hawaii Community Foundation, and the County of Hawaii to respond to the overwhelming concern of the community to the devastating effect that ICE or crystal methamphetamine is having on our children, our families, and our communities; and WHEREAS, monies were put into the budget of the U.S. Department of Justice, assigned to its Community Oriented Policing Services (COPS) agency, passed through the Hawaii Community Foundation (HCF), and awarded to selected County of Hawaii Departments and community agencies in 2004; and WHEREAS, the Office of the Prosecuting Attorney, one of the recipients of the COPS Grant, used its initial funds to create, as part of its Drug Task Force project, two (2) deputy prosecuting attorney positions to work with the County, State, and Federal law enforcement officials in prosecuting individuals and organizations distributing large quantities of ice and other drugs; and WHEREAS, the Office of the Prosecuting Attorney has been awarded second year funding by the HCF to continue its Drug Task Force project; and WHEREAS, the two (2) deputy prosecuting attorney positions will continue to complement the Police Department's enforcement effort by providing prosecution services with regard to warrant review, charging decisions, preliminary hearings, grand jury, trial and appeals; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. HAWAII COUNTY OFFICE OF THE PROSECUTING ATTORNEY DRUG TASK FORCE PROJECT BACKGROUND AND DESCRIPTION OF NEED Drug use, particulazly methamphetamine or "ice", continues to impact the health and well-being of individuals, families and communities in Hawaii County. Property crimes, child neglect, abuse, violence and murder can be attributed to ice and other drug use. The County ofHawaii government, non-profit agencies, businesses and communities, have mobilized efforts to address the problem with a three pronged approach - 1) education and prevention, 2) enforcement, and 3) substance abuse treatment. The Hawaii County Office of the Prosecuting Attorney is a key element of the law enforcement component. Once arrested, offenders must be successfully prosecuted in court in order to hold offenders accountable and to curtail activity. The low-level user, intermediate dealer, and the large-scale distributors require different law enforcement strategies. The Hawaii County Police Department's Ice Task Force has used enforcement efforts against low-level users and dealers to identify and tazget intermediate and lazge- scale distributors of methamphetamine or ice. Identifying and apprehending the lazge- scale dealer is much more complex, requires careful strategy and planning and generally takes a very long period of time to develop. These efforts, however, aze justified as we work toward making the community a safer and better place to live. EXHIBIT "A" PROGRAM STRATEGY The Hawaii County Office of the Prosecuting Attorney is requesting continuing funds for two deputy prosecuting attorneys dedicated to prosecute individuals and organizations distributing lazge quantities of ice and other drugs. These deputies, located in Hilo and Kona, will work with the Police Department's Ice Task force to identify and strategize efforts to cut off the major suppliers of drugs to Hawaii County. They will also work with State and Federal law enforcement officials to prosecute these individuals. The project deputies will also expand the Office's role in both the State and Federal forfeiture programs in order to disgorge any drug wealth. ORGANIZATIONAL QUALIFICATIONS The Prosecutor's Office is the legal agency responsible for the prosecution of all criminal offenses on Hawaii Island. The Office has several specialized units that focus on prosecution of specific azeas such as domestic violence, violence against women, violence against children, cazeer criminals, juveniles and community oriented prosecution. The Drug Task force project is an additional specialized unit that focuses on prosecution of individuals and organizations distributing large quantities of ice and other drugs. The project deputies are Dale Ross in Kona and Jason Skier in Hilo. Ms. Ross, a graduate of the University of Manoa School of Law, has over 19 years of experience as a deputy prosecuting attorney. Mr. Skier, a graduate of the University of Miami School of Law, has four yeazs of experience as a deputy. The project will be supervised by Michael • i Kagami, a graduate of the William S. Richardson School of Law, with over 10 years of experience as a deputy prosecuting attorney. The project deputies and the supervisor will work closely with each other and the police to develop strategy, coordinate efforts and shaze information. WORKPLAN AND TIMELINE See attached. EVALUATION 1. The data collected will be reviewed to determine if appropriate information is being captured. 2.
