Enclosed for your information are memoranda to the Planning Commission dated September 21, 2004 and December 14, 2004. We have also enclosed for your favorable consideration the draft bill amending Chapter 25 (Zoning Code) of the Hawaii County Code relating to uses within the General Industrial (MG) district. Yuen, Planning Director / r _ t't , , SUBJECT: Proposed Amendment to Chapter 25 (Zoning Code), Hawaii County Code I am proposing the attached amendment to Section 25-5-152(a) of Chapter 25 (Zoning Code), Hawaii County Code, which would add "commercial excavation" as a permitted use within the General Industrial (MG) district. While "commercial excavation" is currently defined in the code, it is not listed as a permitted use in any of the zoning district. This proposal would allow such use within the MG district. The hearing on the draft amendment was originally scheduled for the August 6, 2004, meeting in Hilo. However, due to a lack of quorum, it is being rescheduled for the October 22, 2004, Hilo meeting. Some of the commissioners suggested that a Use Permit should be obtained to allow commercial excavation within the MG district; and therefore, deferred action on the proposed amendment As a result of the concern expressed by the commissioners, the Planning Director has drafted a new bill that would allow commercial excavation within the MG district in the following manner: L Allow the expansion of an existing commercial excavation operation, provided that p]an approval is secured from the Planning Director; or 2. Allow the establishment of a commercial excavation operation by securing a Use Permit from the Planning Commission. Attached is a copy of the draft bill. We hope that the new proposal meets with your approval. This matter will be schedule for a hearing for the Planning Commission's January 21, 2005 meeting.
