Dear Chairperson Arakaki and Members
of the County Council:
Re: Resolution for Adopting a Portion of Roadway
Lot 6213 Hawaiian Acres Puna as a County Road
Transmitted is the subject resolution for your
consideration. The subject resolution is for adopting a portion
of Roadway Lot 6213 in Hawaiian Acres as part of the Emergency
Road project connecting Highway 130 to Highway 19.
The piece of real property which the County of Hawaii is
adopting in this resolution is described in the surveyor's
description attached as Exhibit 1. That piece of property is
not yet a separate, subdivided lot, because the owner of the
property must give approval of the subdivision application to
the Planning Department. As the resolution states;
approximately 3,900 lot owners hold undivided interests in the
road. Therefore, the intent is to adopt the roadway as
described pursuant to HRS §264-1(c)(2), and then submit an
application for subdivision to the Planning Department, with the
County of Hawaii as owner. This would then clearly delineate
the roadway lot which is a County road.
It is further requested that this resolution be waived from
Committee and scheduled for the next appropriate Council meeting.
