Subject: Amendments to Chapter 5, Article I, Building Code
Enclosed is a bill for an ordinance to amend Chapter 5, Article 1, in its entirety, of the
Hawaii County Code, regarding Building. This Building Code is the first of three
transmittals. The Plumbing Code and Electrical Code are being sent under separate cover
with the hope that all three can be scheduled for the appropriate committee scheduled to meet
on April 5, 2005.
We are currently using the 1991 Edition of the Uniform Building Code adopted on
November 8, 1993. The Uniform Building Code is an excellent minimum standard for
building construction, however, certain sections in the code do not apply to the local
construction conditions or situations. For this reason, the County of Hawaii has adopted
amendments to the Building Code to address local conditions or situations.
As a part of the adoption process, the County of Hawaii presented revisions to the Building
Code Amendments to the community at four separate meetings. Two were held at the
Mayor's Office in Kona with the majority of the attendees being professional engineers and
architects. Two meetings were held in Hilo, one was attended by the public and professional
engineers and architects and the second was held at the Hawai `i General Contractors
Association's Annual Dinner Meeting.
Significant changes to the amendments to the Building Code are:
• The building permit fees have been reduced for buildings under 1,400 square feet, while
for buildings larger than this, the tees remain the same.

• A building permit will not be required for one detached single-story non-residential use
type building per property. The building cannot exceed l20 square feet of floor area and
must have a height, when measured from the ground, of ] 2'-0" or less.
• Package Model Homes may be pre-approved by Hawaii County Department of Public
Works -Building Division.
• Increase the valuation of work from $1,000 to $4,000 that would require a building
permit.
• Reduce retaining wall height from 6'-0" to 4'-0" that would require a building permit and
an engineer's stamp.
We are requesting to replace Chapter 5, Article 1, in its entirety with the amendments in this
bill. A summary of proposed changes is also enclosed.
