Your Committee on Public Works and Intergovernmental Relations, to which was referred Bill 54.
reports as follows:
Bill 54, transmitted via Communication No. 157, dated March 3, 2005, from Bruce McClure.
director of public works, authorizes four additional loading cones (one for passenger and three for
freight) within Kailua Village. The intent of this bill is to address the lack of loading zones within
Kailua Village.
Chapter ~4, article 10, division 6, section 24-287, schedule 35 (passenger loading zones), subsection
(t~ Kona, of the Hawaii County Code 1983 (1995 edition) is amended by adding the following to be
appropriately numbered and to read as follows:
Ali`i Drive. east side. beginning from a point two-hundred twenty-nine feet north of
Likana Lane and extending dirty-seven feet in the northerly direction, 24 hours daily.
Chapter 24, article 10. division 6, section 24-288. schedule 36 (freight loading zones), subsection (I)
Kona, of the Hawaii County Code 1983 (1995 edition) is amended by adding the following to be
appropriately numbered and to read as follows:
( ) Ali'i Drive, cast side, beginning from a point two-hundred seventy-six feet north of
Likana Lane and extending sixty feet in the northerly direction, 24 hours daily.
( ) Ali'i Drive, east side, beginning from a point five-hundred thirty-three feet north of
Likana Lane and extending forty-six feet in the northerly direction, 24 hours daily.
( ) Ali`i Drive. west side, beginning tiom a point one-hundred fifty-four feet south of
Kakina Lane and extending seventy-seven feet in the southerly direction.
The department of public works monitored the temporary freight loading zones along nli'i Drive.
Pete Hendricks of the mayor's office in Kona stated that there has been nothing but positive feedback
at his office. Marie Aguilar of the Kailua Village Merchants Association also stated that there was
no negative feedback. Of the six vendors who responded, there were five with positive reviews
(Better Brands, Southern Wine and Spirits, Suisan, Coca-Cola, and Y. llata) and one with a negative
review (Pepsi). Councilmember Dr. Fred Holschuh commented that he was happy that public works
had taken the time to document responses from the Kailua Village Merchants Association and the
six vendors.

During discussion, there was some contusion about the 90-day testing period. The director of public
works has the authority to make temporary changes in parking and traffic controls for a period of
90 days, pursuant to the Hawaii County Code, section 24-11. While the council is considering this
bill for a permanent addition of loading zones, the administration will be extending the test period
for another 90 days, which will begin on March 19, 2005 and end on June 15, 2005. In short, the
amendments in this bill arc permanent and will take effect on the date of its approval.
Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose
and intent of Bill 54 and recommends it pass first reading.
