Re: Dedication Deed - Kukuinui Subdivision -Increment 1

We are transmitting for the Council's review and consideration for acceptance a copy of
the above draft dedication deed, along with a resolution accepting the deed. Due to the pressing
need for the interconnectivity this dedication will provide between Nana Street in the Kona
Wonderview subdivision and Holoholo Street in the Kona Palisades subdivision, the Deparhnent
of Public Works is requesting that this dedication be waived through committee and placed on
the full Council agenda at the earliest possible time.
For your information, the deed has been reviewed by the Department of Public Works,
Department of Water Supply and the Planning Department and all have recommended
acceptance of the dedication deed. All subdivision improvements have been completed. Also
enclosed are copies of transmittals from the Department of Public Works, Board of Water
Supply and the Planning Department.
Please note that the dedication deed at this time is subject to the developer's interest in
the water system improvements which the developer covenants to convey to the Water Board.
A bill of sale for these improvements has been tendered to the County Water Board, and will be
accepted at the Water Board's meeting of April 26, 2005, inasmuch as the Department of Water
Supply has certified the water system's suitability for acceptance.

Upon acceptance of the above dedication deed, please send notification of such
acceptance to: (1) RS10 Kalaoa, LLC, a Hawaii limited liability company, P.O. Box 789,
Kealakekua, Hawaii 96750; (2) Department of Public Works; and (3) William Takaba, Director
of Finance; and (4) Ivan M. Torigoe, Deputy Corporation Counsel, who will record the said deed
with the Bureau of Conveyances.

RE: Resolution No. 81-05 transmitting a resolution accepting the
dedication of Road Lot A (Kukuinui Street) and Road Lot B (Ohikapua Place),
Holoholo Street Extension Lot and Nana Street Extension Lot of Kukuinui
Subdivision from RS10 Kalaoa, LLC, a Hawaii Limited Liability Company,
Situate at District of North Kona, County and State of Hawaii, Tax Map Key (3)
73-1037, to the County of Hawaii.
Pursuant to Section l (g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the committee on Public Works and Intergovernmental Relations to the full Council
for immediate action. In reviewing this matter, timely approval is crucial. It is therefore
advantageous that approval is granted and the matter placed onto the next Council agenda for
review. However, in the event this request is denied, for whatever reason, 1 understand the
matter shall be referred to the Committee on Public Works and Intergovernmental Relations for
placement on its future agenda.
