This it to aclrnowledge receipt of your letter dated June 6, 1997 providing an annual report
for the above-referenced ordinance and to also request an extension of time to wmply with
Conditions D and T.
For your information, by letter dated November 13, 1996, the Planning Director granted an
initial extension of time to comply with Conditions D and T. Based on this extension, this
request must be forwazded to the Planning Commission for final approval by the County
Council.
Prior to processing this request, a $250 filing fee with 20 copies of your request must be
forwarded to our office. In addition, the new Zoning Code, in effect on December 7, 1996,
requires you to inform surrounding property owners twice -initially upon submittal of your
request for a time extension and again upon notification that a public hearing is scheduled.
We have enclosed an information sheet to assist you in the surrounding property notifications.
Although, we can use your initial letter as your request, please clarify in writing, the length of
time extension you aze requesting for. y '

Dear Ms. Goldstein,
As you have heard from Ms. Sandra Pechter Sa:.hutte, she has had the
gcxxi fortune of being appointed to the office of Judge of 'the District Court for
the Third Circuit and therefore will no longer be representing Kukuihaele
Levelopment Company irl the above matter,
I am writing to you at this tame to give you an update on the pluject and
to request an extension of Conditions D (development of an ofd' site water
system) and Condition T (conveyance of 4,1 acres of land to ts~Ie adjollling ~`iger
Camp lot owners and tht !ot owners near the former grade sehcxl playground)
which otherwise expire on June 7, 1997.
Due to the continued depressed economy irI th~° State and on ilaw;~i
Island we have not yea been able to obtain the necessary flnarxcing to
co:runenr,e the project. This has not been due to any lack of effort on our part.
At the commencement of this project Silverlinlc Holdings, Ltd., one of the joint
~.reniul°e paI-trers in Kukuihaele Development Company had another
tlxvestnxent partner prepared to participate In the project. After that party
deciried to not proceed we have worked with many other potential partners in
arI Pli0i'L to Finance the development.
At tFlis time no one is benefiting from all the et°i'orts that the eoarununit_s~,
the govwrnment ant! r,urselves have put forth, 4Ve have been trying to find a
way to prflceed ir. *_llese continuing difficult illxaneial times, We believe that
the best solution may be io state the project tnie two phases. Tire first phase
would tlxvaive land we already ti;vn and Elie second phase would. involve the
Rpttkrl Catl:alic Church lands. The first phase would be on the 21 acres of
hotel ~Ixed ',s7nd which includes the 'Plantation Manager's fisrate. The second

phase would include the purchase of land imin the Catholi:: Church and the
development of the 15 acre site on the cliff top and the s~srraunding land.
At this time we would like to simply request an extensle:? of the existing
zoning, There are still swine potential investors whc ~•ue considering funding
fhc entire project as originally petm±tted. if we do go forward on the two phase
basis. we would submit to the Planning Department, the F'l~uutitig CommLssion
and the County Council our proposed amendment to the e3csting wising. We
felt *.he time tc do that was after we obtain financial commitments on the first
phase. Based c.n those financial commitments we would go before the above
mentioned government bodies to present the change request.
Cher the past se.~eral months we have spoken with massy of tite
conununity leaders in Kukuihaele to better understand their feelings abcui
this project going forward. The over~vhrlmixtg attitude has been one of
frustration at the project not has^!ng started. But the feelings are not one of
wanting it abandoned by ourselves or the County Uut rather one of wanting
something, even if on a srnalier scale, tc be started as soon as possible.
We have also been working very closely with Richard Bahar at the
Depa:-trnent oi' Business and F'.conarnic Development. Mr. Baltar has been
introducing potential investors and guiding us in our efforts to attract
investors under the investor visa program.
At this time Silveriink Holdings, I.td. and Royal Coast Resoirts
C.i,rporation have millions oe dollars invested in this project. We are bath
willing tc go forward with this project but need more rime. 'Vi'e request that the
Flanriing Departzrient and the other government bodies please ronsider Uur
request favorably not only far our sake but for the sake of the Hanu~kua
Community.
