Communication No. 172 reports that the Hawaii County Planning Commission, as required by the
I lawai'i Counts Charter, Article VI, Chapter 4. Section 604.3(0), considered the above rcyuest on
Lebrun?} I K. 2005. At this meeting. the Commission concurred with the Planning Director's favorahle
recommendation I~xappruval of~his matter. Communication No. 172. in summary. reports the Planning
Uirector's reconunendalionsind tindings as follows:

,lgricuhural S-acre (A-Sa) to Family Agricultural 3 acre (PA-3a) for 7Jd acres of land.

Surrounding parcels arc zoned A-3a.

properth as 7onc "X". an area determined to he outside of the 500-year flood plain.
I'hc Change of Zonc reyucst conforms to the North Kohala Community Development Plan
(CDP), which rcconunends in the Agricultural element to "encourage more intensive use of North
Kohala's agricultural resources through the subdivision of selected agricultural lands into smaller
and more manageable parcels." l~hc Land Use Concept Guide Map of the North Kohala CDP
designates this area for Small Scale Agricultural (PUD). "I'he proposed FA-3a zoning would be
contia numcc ilh the North Kohala's CDP land use strategy planned tier this area.
G. I he proposed request will not have a significant adverse impact to traditional and customary
I lawaiian rights nor will it have an impact o? historic, cultural, archaeological features, or
endangered species or fauna on the parcel. An Archaeological Assessment Survey conducted h}'
Paul I I. Roacndahh Ph. D, of PHRI found "no archaeological remains of any hind were identified
during the licld inspection."

8. I he Planning Direcloi`s tavorahle recommendation contains 14 standard conditions, which the
Council finds arc (I) nccessarc to prevent circumstances which may be adverse to the public
hrlhh. safety and welfare or (2) reasonably conceived to fulfill needs directly emanating fi~om the
land use proposed w id) respect to: (A) Protection of the public from the potentially deleterious
effects of the proposed use, or (R) Puliillment of the need for public service demands created by
the proposed use.
