SUBJECT: REQUEST FOR PROPOSAL NO. 2146: FINANCING, DESIGN,
CONSTRUCTION AND OPERATION OF A SORT STATION
AND/OR MUi~~ICIPAL -SOLID WASTE REDUCTION FACILITY
FOR THE DEPARTMEl~IT OF ENVIRONMENTAL MANAGEMENT,
COUNTY OF IIAWAI'I
`Thank you for your proposal and follow-up responses to our requests for additional
information. The evaluation committee reviewed all information submitted slid
determined that canceling the current procurement, rather than declaring individual
proposals as :non-responsi~ye, was in the best interest of the County of Hawai' i.
Please be informed that under State: of FIawai' i procurement rules all proposals
become public when an award is made, or all proposals are deemed non-responsive,
except for the portions marked confidential or proprietary. The committee believed
there was a benefit to keeping the proposals confidential, at least for the time being,
in an effort to protect sublrittals from competitors, and when a new procurement is
completed.
The County's February 16, 2005 and April 1, 2005 correspondences detailed
deficiencies in your proposal and provided your firm with an opportunity to comply
with the requirements set forth in the subject Request for Proposal (RFP). Since you ~ ~
would like more information as to the exact nature of the evaluation committee's ~ , ~ ~
decision, the following summary is provided. The evaluation committee noted that o ~
your proposal, and subsequent information provided upon request, did not include: ~
• A commitment to a $5 Million performance bond. County Council Resolution 218-04
required-the performance bond to assure continued solid waste disposal services, regardless
of the provider. Adequate fundang is essential in preventing disruption of public services.
The committee further noted that a letter of credit is not the same as a performance bond
because the County is not the beneficiary of any letter of credit issued to a third party. The
committee notes that during a 20-year contract costs in the range of $100 Million dollars of

commit to this project, the requirement of a performance bond is deemed anon-negotiable
item, and cannot be waived.
• A clear commitment to county ownership at the end of 20 years, or another time frame, at a
set price. Without this information, the committee cannot determine the true costs of such a
large project and the County, as well as the taxpayers, will be placed in a dangerous
position at the end of any contract. The RFP, and subsequent requests for information,
clearly requested you to provide abuy-out cost to the County.
• Cost breakdowns. The cost information provided by you was insufficient in detailing
actual costs for providing the services proposed in the RFP. The committee found that true
costs were not obtainable from the information provided.
• Adequate experience with a representative system. The committee was not provided
evidence of electric power generation and sales experience. Combined with the lack of a
performance bond, the committee determined that your proposal lacked the guarantees and
assurances, in combination with critical operations experience, to justify award of a
contract.
In conclusion, the above issues were among the most critical problems identified in your
