At the Hawaii County Council's Finance Committee meeting held on
May 3, 2005, Council members raised very valid issues concerning the content of
the above-referenced lease agreement.
We learned that based on the urgency of this matter, the Department of
Parks and Recreation submitted its draft copy of the contract to the Council at the
same time the draft was submitted to our office for review. In other words, our
attorneys had not reviewed this document prior to its submission to the Council.
Deputy Corporation Counsel Diane Noda has been assigned and will be
responsible for working with the Department of Parks and Recreation in the
review and amendment of this proposed contract. I invite you to contact Ms.
