Dear Member of the Council,
We have been informed that the County is trying to authorize the acquisition
of private property (3) 7-3-005:111, by eminent domain for the development
and construction of a connector road between Holu Street and Ke'oke'o
Street in Kailua-Kona.
It has come to our attention that the County has obviously overlooked the
fact that there is another parcel between TMK: (3) 7-3-005:111 and
Ke'oke'o Street.
We have a great concern, for we are one of ten homeo+vners in the
Matsumoto Subdivision. We have a 1140 interest in this parcel, TMK: (317-
3-005:101 located between TMK: (3) 7-3-OOS-111 and the county road on
Ke'oke'o Street.
We are requesting a resolution authorizing the acquisition of private
property by eminent domain. We want to be assured of our release of any
responsibility and/or liability regarding the condemnation of this property.
This issue must be addressed before the County proceeds with Resolutior.~
84-05.
This letter shall suffice as our proxy, for we are not able to attend the
meeting set for Tuesday, May 3, 2005.
