''US 69 AN ORDINANCE AMENDING CHAPTF,R 2, ARTICLE 27, SECTION 2-153 OF THE HAWAII COUNTY CODE, RELA'f[NG TO REVISIONS OF "I'HE COUNTY CODE. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The County Council tinds that it would enhance efficiency if the County clerk, rather than the corporation counsel, prepared supplements to the Hawaii County Code. Technological developments and the improved records management system allow the County clerk to maintain the I lawai`i County Code. Given these developments and the amendments to the Code made over the years, the County Council also authorizes republication of the Code. The Council also finds that the Code should be amended to use gender neutral terms when referring to both genders. SECTION 2. Chapter 2, Article 27, Section 12-153, Hawaii County Code is amended to read as follows: (a) [A . ftor the sl of each calendar ~,~~ar 4 anarter. t e ssmsrat~c~n seattsel] Semiannually, the County clerk shall prepare for publication aloose-leaf supplement to the [~lasvaii] Hawaii County Code. The supplement shall contain al] ordinances of a general and permanent nature enacted subsequent to the last revision, republication, or supplement to the [I-Iawait] Hawaii County Code. (b) In preparing the supplement to the [Hawaii] Hawaii County Code or the republication of a new edition, the [e~--.,._°~~~ County clerk shall review all ordinances to be included and may: (I) Number and renumber chapters, sections, and pans of sections; (2) Rearrange sections; (3) Change reference numbers to agree with renumbered chapters, divisions, or sections; (4) Substitute the proper section or chapter numbers for the terms "the preceding section," "this ordinance," and like terms; (5) Strike out figures where they are merely a repetition of written words; (6) Change capitalization for the purpose of uniformity; (7) Correct manifest clerical or typographical errors; {8) Correct the spelling of Hawaiian words and names; (9) Change any male or female gender term to a term which is neutral in gender when it is clear that the ordinance is not applicable only to members of one sex without altering the sense, meaning, or effect of anv act; and [(Sj] ~ Make such other changes in any ordinance incorporated in the supplements as shall be necessary to conform the style thereof as near as may be with that of the last revision of the [~awai-iJ Hawai`i County Code; provided that the changes shall not alter the sense, meaning or effect of any ordinance. The matter set forth in the supplements shall be prima facie evidence of the law. (c) The County clerk shall prepare and publish a June 30, 2005 edition of the Hawaii County Code. After republication, the County clerk and the director of data systems shall ensure that the Hawaii County Code is posted on Che county's website and is updated as soon as possible at the end of each quarter. Use of the code on the county website, however, is at the sole risk of the user. The County makes no warranty or representation of anv kind regarding its content and shall not be held responsible for any unintentional omission, addition, or error in or loss of service or data; or for any breakdown, interruption, or delay in service. SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 4. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
