Resolution K3-O5, reports as lollows:
Resolution K3-0>, transmitted via Communication No. 225, dated April 19. 2005, from
Gerald 'fakasc. assistant Corporation Counsel, authorizes the acquisition of private prolxrty h}
eminent domain. "I~hc properties being Lot R-l, Tax Map Key: (3)7-3-010:029, and Road Lot A,
~faz Map Kcy: (3 ~7-3-010:036 (portion). situated at Kalaoa, North Kona, County and Stale ol~
I la~iai'i. 'this acquisition is for the development and construction of a connector road between
Rauhale Street and Ahiahi StrceL Kona. I lawai'i.
Council Member Roh .lacobson said that he would support this resolution. He was pleased that this
process was straighttbrward and that there were no County giveaways tied to the resolution, such as
a rcyuest ibr rezoning.
David Young. one of the property owners. said that a 550-foot portion of the road was huilt to
Counh- standards with the intent to dedicate it to the County, but the resolution does not reFlect that.
I Ic further stated that in exchange Ibr the dedicated roadway, he wanted the County to consider
graining him water rights for future development in the area. However, prior discussions with the
Planning Department and the Department of Water Supply did not result in any agreement. llireclor
of Public Works Bruce McClure indicated that the road was not accepted for dedication because an
agreement could not be rcachai with the landowners. The main roadblock to an agreement tias the
issue of water. h1r. McClure further explained that although the County could wait fin' the road to be
dcdianed, the County was proceeding with this resolution in order to speed up the process.
Assistant Corporation Counsel Gerald 'hakase responded to the water issue by saying the Department
of Water Supply does not have enough capacity and was therefore not interested in granting a water
commitment to Mr. Young at this point in time. Council Member K. Angel Pilago remarked that the
issue was not the granting of water rights. but to address problems with traffic. Moreoecr_ Mr. Pilago
said that this connector road will provide greater public safety, especially for tire, police. and
cmer~!encv medical services.
A 20-~bot-~~idc road is better than no road at all at this time, according to Council Mcmbcr
Virginia Ishcll. She also stated that currcntly_ water cannot be made available because there is not
enough capacity in the water ststem.

According to Mr. McClure, the plan is fin- the County to build a 20-toot-wide connector road.
Council Mcmhcr Gary Sal~~rik asked if there has been a change in policy in accepting County
o~nnership ofsubstandard roads, and ifso, could these standards be applied to Puna'? Mr. McClure
responded that there is an A-mile substandard road in Puna owned by the County, which is Ainaola
Dricc. N1r. McClure also slated that this situation for County ownership of a substandard road is un
csccption. 'Ihc County will not apple this special case policy island-wide.
Your Committee on Public Works and Intergovernmental Relations is in accord with the intent and
purpose of Resolution 83-05 and recommends it pass lust reading.
