Resolution 8d-05, transmitted cia Communication No. 225. dated April 19. 2005, fi'om Gerald
~fakase. Assistant Corporation Counsel, authorizes the acquisition of private property by eminent
domain. l~hr property being Road A.'hax Map Kcy: (3)7-3-005:1 11, situated at Kalaoa, North
Kona. County and State of f lawai'i. 'this acquisition is for the development and construction ofa
connector road hehvccn I Iola Street and Kebke'o Street in Kona. Hawaii.
Council Mcmhcr Virginia Isbell rc~crred to a letter Isom Bob and Pat Aeder, dated May 1. ?005.
expressing their concerns over a tell hn~n from Kebke'o Street on to Kaiminani Street and a right
turn from Kaiminani on to Ke'oke'o Street, and they have asked Director of Public Works Bruce
McClure to respond. Mr. McClure stated that sight distance and turning issues arc often the result of
going too fast and that ifdrivers lullowed the. posted speed limits, right and left turns could hL done
salcly.
Hob Aeder spoke and reiterated concerns expressed in his letter. He also added that the transition
From Kc`oke'o Stred to I Iola Street will be dangerous, because Holu Street is very narrow and has a
steep slope. I Ic also raised the issue of land ownership, and claims that the resolution does nod
account fiu all the possible owners of the property. Assistant Corporation Counsel Gerald ~fakase
responded that according to the title report the property in question (parcel I 1 1) is owned enlirel~
h~ Harue N1a~sunxrio.
Council Mcmbcr K. Angel Pilago said that he would ibllow-up with Die Deportment of Public
Works regarding the safety issues raised, and also follow-up with Corporation Counsel regarding the
land ownership issues. Council Member Bob .lacobson asked for clarification on parcel 101 .
Mr. I akase answered that the Counq~ has in its possession a dedication deed from one of the owners
fur that parcel, however, the ownership may not be 100 percent. If needed. the County can deal with
the rest of the ownccs later. Having the dedication deed allows the County to proceed with the
process. Morcova~_ Mr. 'I~akasc explained that this resolution covers parcel I 1 1 only, which is the
Matsumoto properly. In response to possible satety measures. Mr. Takase said that he has discussed
the possihilitc of implementing traffic-calming devices with some of the residents in the area.

nlso, in response to Mr. Pilago, Jiro Sumach. Deputy Director of Public Works, commented that he
went to the project site with Public Works F,ngineer Robert Yanabu after receiving a call from
Mare Ann Todd-Waller, who they met at the prrrject site.

at and mitigate moll of the solely issues. And, like Mr. McClure, he cited speeding as a lactor in

n concern raised b.• Council Member James Arakaki was that the County would lace liability issues
by increasing the h'al~lic on a substandard County road. 1{e asked Mr. Sumach if Holu Street is a
County road. and ifso. is it a substandard road? Mr. Sumach replied that Ilolu Street is an existing
Counts rood and that it is substandard and will probably remain substandard, but that improvements
ill he made to address safch• concerns.
Council N1cmher Isbell motioned for the creation of a Tact-linding committee headed b} Mr. Pilago
to address the outstanding issues that need to be resolved. Joining Mr. Pilago on this committee will
hr Ms. (shell and Mr. Ikeda.
Your Committee on Public Works and Intergovernmental Relations is in accord with the intent and
purpose of Resolution 8d-OS and recommends it pass tirst reading.
