Your Committee on Finance, to which was referred Resolution No. 86-05, reports as follows:
Resolution No. 86-05, transmitted by Director of Finance William Takaba, via Communication No. 231
dated April 19, 2005, authorizes the Director of Finance to negotiate a lease agreement for the former
caretaker's cottage at Spencer Park at `Ohai`ula Beach to the Historic Hawaii Foundation.
The County of Hawaii is the owner of the premises described as the former caretaker's cottage at
Spencer Park at `Ohai`ula Beach, South Kohala, Hawaii, located within Tax Map Key: (3) 6-2-02:08.
The Historic Hawaii Foundation, anon-profit organization, desires to lease the premises for the purpose
of restoring the building and using it in the future for educational purposes.
Pursuant to Section 2-120 (a)(2), Hawai`i County Code, the Council of the County of Hawaii may, by
resolution that is approved by a majority of its members, direct the Finance Director to negotiate the
lease of real property to non-profit organizations, at such rentals and on such terms and conditions as
deemed proper. Pursuant to Section 2-120 (b), Hawaii County Code, such lease of real property to non-
profit organizations may be made without notice or appraisal as required in Chapter 2, Article 19.
During its discussion, Your Committee requested that the Corporation Counsel review the lease contract
and amend section 7, relating to improvements, prior to the next Council meeting.
Further, Dr. Holschuh requested clarification of section B-2, relating to Covenant against discrimination
and the term "familial status".
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 86-05 and
recommends its adoption.
