Heavy agricultural and construction vehicles used for Mr. Norrie's businesses have caused damage to the existing private road During a meeting with Mr. Christopher Norrie, my husband, Larry Ford, and myself, I expressed concern regarding the existing damage and cracks in the private road between lots 46, 5B, 6B, and 76 ("upper lots") that are due to the heavy agricultural and construction vehicles used by Mr. Norrie's businesses. Mr. Norrie verbally stated to us, that if we thought the private road should be repaved that repaving would not be a problem. He stated that as the trucks carrying asphalt would be out here anyway, the paving company could place 2-3 inches of asphalt on top of the existing private road between the upper lots. Mr. Norrie stated that only smoother aggregates (#4 or #5) could be used on top of #3 sub-base which unfortunately would provide a more smooth and slippery surface than currently exists. He recommended NOT re-paving. To determine the truth of whether the cracks and damage should be repaired, I contacted 3 paving contractors listed in the Yellow Pages of the local telephone directory (Bolton Asphalt, Grace Pacific, and Big Island Paving). In separate discussions with these three (3) paving companies, I learned that: 1. #3 sub-base (1/2 inch aggregate) is excellent for a steep road as it provides excellent traction and a very long life 20 years) but also that #3 sub-base can be used over #3 sub-base if a tacky layer is placed on the original road first to provide good adhesion. 2. "Single Line cracks" of more than 1/2 inch will allow water to seep under the road and wash away the fine particles in the road base allowing the road to settle. The area of the road with these large, single line cracks must be repaired or erosion under the road will occur. After a period of time, "alligator cracks" will form. Alligator cracks are cracks running in two or more directions forming an irregular block appearance (e.g.( These blocks indicate serious sub-base erosion and settling of the base 4 course. The section of the road with alligator cracks must be removed, a new base course placed, and re-paving of the road section is required. On September 30, 1997, I again walked the length of the private road between the upper lots to determine what visible damage had occurred on the road. I witnessed more than 5 locations with "alligator cracking" and more than 5 locations with single line cracking of various widths. The existing private road in Ka'awaloa Orchards subdivision is only 9 years old but shows the damage of a road more than 20 years old due to the intensive use by heavy cow. >~0. `f 52.0 9 ~ GOJNCI~ )sal. i,~ OCT 1 1997 vehicles. The only heavy vehicles using the private road are for Mr. Norrie's businesses as the local residents have only passenger cars and light pick-up trucks. I am requesting that as a condition of approval for the extension of the private road for the APD, the County Council insist that: a. The existing private road be appropriately repaired and brought to a condition equal to a paved road without damage. b. Any paving, repair, and/or upgrades of the private road will occur after all the grading or construction equipment has completed the construction of the lower 7 lots but no later than three (3) months after beginning the grading and construction of the private road extension to the 7 lots. B. Pig control Mr. Norrie placed and maintained an electric pig fence below the upper lots in the past. The fence is currently not operational. I request that the County Council insist that Mr. Norrie refurbish and maintain the pig fence to prevent pigs from encroaching into the upper lots for as long as any of the lower lots are owned by Christopher Norie, his subsidiaries, or corporations in which he is a major participant. C. Maximum number of lots to be served by the private road To protect the property values and limit the financial liability of the existing upper lot owners, I request that no more that 11 lots maximum (of a minimum size of 2 to 3 acres each) to have access to or use of the private road.
