September 29, 1997
. - ` ~ RECENED ~
1Lm
Regarding: Bill 129 -Amending the South Kona Zone Map -7--r Bv,-------------------
D°"'
We, the neighbors of Ka'awaloa Orchards subdivision ("neighbors") with lots 46, ~u~ C$~q~l
76, have a vested interest in providing safety, security, and limiting liability for ourselves and
our families for the maintenance of and access to the private road serving the Ka'awaloa
Orchards subdivision ("subdivision").
In multiple conversations between the neighbors and Seamount Enterprises owned by
Christopher Norrie, and his representative, Sally Rice, Mr. Norrie has made verbal
commitments to the neighbors regarding the repair of and limiting access for the private
road to the four (4) existing lots and the proposed seven (7) lots of the subdivision you are
considering in Bill 129 (maximum 11 lots). The private road has already sustained damage
beyond normal wear and tear caused by heavy vehicles used for Mr. Norrie's businesses and
now will have to support excessive construction activity with the Agricultural Project District
application. Recently, Mr. Norrie has verbally reneged on his promise to repair the existing
damage caused by both heavy construction and agricultural equipment between lots 4B, 5B,
6B, 7B.
Sandra Pechter Schutte in representing Seamount Enterprises, LLC has represented to Mr.
Galen Kuba, Department of Public Works, and Ms. Virginia Goldstein, Planning Director, in
letters dated May 29, 1997, that "there will not be any further roadway connected to this
private road." Recently, Mr. Norrie has admitted verbally that an additional eight (8) lots
owned by Mr. Norrie immediately adjacent to the subdivision have the right to use the private
road. These eight (8) lots are 5 acres or larger and with ohana housing can thereby add
sixteen (16) more houses for a potential total of twenty-seven (27) families using the already
existing and damaged private road.
Therefore, it is imperative that as a condition of approval and construction that:
1. Use of the private road be limited to the existing neighbors and the subject expansion of
the Ka'awaloa Orchards subdivision for a total of eleven (11) lots.
2. After the private road grading, widening, and extension to lots subject to Bill 129 (lots 1A
through 7A) of the subdivision, the private road from Napo'opo'o Road onward must be
repaired and resurfaced in accordance with the guidelines incorporated in the Hawaii
Statewide Uniform Design Manual for Streets and Highways for approval of the APD
applicat/~ion.
yC- ~ -
erian Lievens Andrea Lievens
Owners of Lot 46 of Ka'awaloa Orchards subdivision
Lawrence Ford, Sr. Brenda Ford
Owners of Lot 5B of Ka'awaloa Orchards subdivision
Eric Curt Elizabeth Curtis
Hers of Lo a'awatp Orchards subdivision
nnar Freivalds Ba a Allen a
Owners of Lot 7d of Ka'awaloa Orchards subdivision lfir Ida.
