Cear Members of the Planning Committee:
The undersigned's law firm represents 96 lot owners
who have purchased property in the Hokuli'a Development.
We write to express, on behalf of our clients strong
opposition to Bill 80. It is our understanding that Bi11
80 is now under consideration by your Committee.
As you may be aware, adoption of the aforementioned
Bill would violate the lot owners' rights, as contained in
the Development Agreement that the County of Hawaii has
signed with 1250 Oceanside Partners. Our clients are the
intended and third-party beneficiaries of that Agreement,
and the adoption of Bill 80 would prohibit certain elements
contained in the Development Agreement if Bi11 80 applies
to the Hokuli'a development. Hence, we, on behalf of 96
lot owners request the Planning Committee reject Bill 80 or
make clear that its terms do not apply to the Hokuli'a
Development.
