Re: Hokuli'a and Bill 80
Dear Members of the Planning Committee:
This law firm represents 1250 Oceanside Partners, the developer of Hokuli'a. We write to
express Oceanside's strong opposition to Bill 80, now under consideration by the Planning
Committee.
Adoption of Bill 80 would violate the County of Hawaii's obligations as set forth in its
Development Agreement with Oceanside. In exchange for the many obligations undertaken by
Oceanside, the County agreed that it would not impose any new land use laws or regulations on
the project for a period of twenty years. The development plan for Hokuli'a, repeatedly
approved by the County during a seven year public approval process, contains certain elements
that would be prohibited by Bill 80.
1250 Oceanside Partners request that the Planning Committee vote to reject Bill 80 or make clear
that its terms do not apply to Hokuli'a. Taking such action would be consistent with the
County's obligations under the Development Agreement and prevent needless litigation.
