RESOLUTION NO. 111 5
RESOLUTION AUTHORIZING THE MAYOR OR HIS DULY AUTHORIZED
REPRESENTATIVE TO NEGOTIATE AND EXECUTE AN AGREEMENT TO
ADMINISTER THE DEPARTMENT OF HAWAIIAN HOME LANDS REHABILITATION
LOAN PROGRAM
WHEREAS, the Hawaiian Home Lands Homeownership Act of 2000
(HHHA)authorizes the Department of Hawaiian Home Lands (DHHL) to
carry out affordable housing activities for low income native
Hawaiian families who are eligible to reside on Hawaiian Home
Lands; and
WHEREAS, Native Hawaiian Housing Plans (NHHP) for FY 2003-
04 include funds to work with the counties to assist families in
repairing their homes; and
WHEREAS, the Hawaiian Homes Commission approved the NAHASDA
Home Repair Program on September 23, 2003; and
WHEREAS, the NHHP was approved by the U.S. Department of
Housing and Urban Development (HUD) on October 29, 2003; and
WHEREAS, the County agrees with the DHHL that there is a
need to repair and maintain existing housing units on DHHL
leaseholds in Hawaii County; and
WHEREAS, the work assigned under the Agreement consist of
implementation of the DHHL Rehabilitation Loan Program within
the County of Hawaii for beneficiaries of the Hawaiian Homes
Commission Act of 1920; and
WHEREAS, Section 2-73, Hawaii County Code, requires that
all instruments and documents be signed by the Mayor as
authorized by the Charter and the Council; and
WHEREAS, it is required by the DHHL that the County of
Hawaii enter into an Agreement and other documentation assuring
conformance to related rules, regulations and laws of the
Department of Hawaiian Home Lands Rehabilitation Loan Program.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that the Mayor of the County of Hawaii or in his
absence, the Acting Mayor, is hereby authorized to execute the
Agreement and other related documents with the DHHL.
BE IT FURTHER RESOLVED that the Mayor or his authorized
representative is designated to act as the representative of the
County.
BE IT FURTHER RESOLVED that a copy of this resolution be
transmitted to the Office of Housing and Community Development.
