Hilo, HL 96720 .I~.uua~--~ Hawaii County Transportation Commission 25 Aupuni St. Hilo, III. 9720 IZI: Leasing of Taxi Cab Licenses Dear Commissioners, Chapter 18, Article 1, Div. 3, Section 18-6 (A) of Hawaii County Code states "loo carrier operating upon and using the Public Highways of the County shall furnish an;~ service without first obtaining from the commission a certificate declaring that public convenience and necessity require the operation and service". This again is clearly stated in Article 2, Div. 1, Section 18-32 of Chapter 18 of Hawaii County Code. Yet, some taxi operators are by passing this procedure by leasing the licenses from the legal certificate holder, Then the leasee represents his operation as a different company. Likewise these leases of taxi licenses are not bound by 18-33 of Hawaii County Code, llearing; factors considered; revocation. This is unfair and unjust! One operator in East Hawaii has had his application denied twice yet he is operating by leasing a license. And if 18-33 of County Code is circumvented then "Demonstrated Need" is not fair for legal certificate holder to prove and leases to not prove. Also the question of moral character cannot be addressed. This has been the point of several applicants being denied in the past (Drug convictions, criminal charges, DUI's, etc.). Therefore, I am asking that these operators who are leasing licenses be required to file an application for certificate of Public convenience and necessity with the Mass Transit Agency to be heard before the Hawaii County Transportation Commission before providing service to the public. This will assure the public and the indushy that the quality of taxi service in our County will parallel the quality intended in the County Code. I feel this matter should u~~doubtedly be Drought before the hawaii County Council for review of this unfair loop hole! I am asking this matter be on the next agenda of t9ie Hawaii County Transportation Commission's meeting; regular quarterly„or special meeting.
