Dill No. 92 seeks to amend Conditions R. C. and O of Ordinance 92-7, which rezoned
approzimatcly 6.00(13 acres of land from agricultural 3-acre (A-3a) to a Single Family
Residential (RS-10) district.
Communication No. 2dl reports that the I Iawai'i County Planning Commission. as rcyuired by
the I lowai'i Counh Charter. Article VI. Chapter 4. Section 6-43(c), considered the above
recµiesl and accompanying Bill No. 92 on April 1, 2005. At this meeting, the Crnnmission
concurred ith the Planning Direckn`s favorable recommendation for approval of this nuri~er.

Brian Anderson from Puluwai. I.LC submitted a mcmorandment dated May 31, 2005,
rcyucs~ing the climinalion of Condition K fix the lollowing reasons:
• I he original ordinance 93-7 did not include this condition.
• Including Condition K to this ordinance will add in excess of $200,000 to this project.

application comes in for a time extension. the fair share contribution and affordable housing
conditions arc added.
Ihu~ing its discussion, Your committee toted to amend Rill 173 with the following:

impacts of the property with respect to parks and recreation, lire, police. solid waste
disposal facilities and roads. 'hhe fair share contribution shall he initially based on the
representations contained tiithin the change of zone application and may be increased or
reduced proportionally if the lot counts are adjusted. l~he fair share contribution shall
become due and payable prior to receipt of Final Plan Approval or within live years from
thr cifccli~'c date of this amended change of zone ordinance. whichever occurs f irsl. "I he
fair share amtributiun for ouch lot shall be based on a maximum density for each lot as
determined by du zoning resulting from this change of zone. "fhc fair share shall uE~~ily

Four Committee concurs with the Planning Commission and the Planning Director's favorable
rcannmendation Ibr approval of the amendments to Ordinance 92-7.
Four Conuniuce on Planning is in accord with the intent and purpose of Bill No. 92, as amended
to Uraft and recommends it pass lirs[ reading.
