Higa, Chairman and Members of the Hawaii County Council Hawaii County Council 25 Aupuni Street Hilo, Hawaii 96720 Re: Capital Budget Approval by the Hawaii County Council is being requested to create a new CIP appropriation to fund the land acquisition of the property found at TMK (3) 7-5-18:020, commonly known as "Honl's beach" and that is currently owned by So-Bay Hawaii, Inc. The property contains an attractive white sand beach that would provide a valuable public beach recreational resource for the County's residents and visitors alike. Currently, there is no agreement in place that affords public access to Honl's Beach or that permits public use of the beach. This is, in all likelihood, one of the few opportunities the County will have to add to its North Kona beach park inventory though outright ownership, especially in such a prime location (geographically and recreationally speaking). Enclosed is a bill for an ordinance adding the Honl's Beach Property Acquisition project for $3,100,000 to the FY2005-06 Capital Budget. This appropriation will address the purchase of the property including incidental and appurtenant costs, such as, but not necessarily limited to, a real estate appraisal and the preparation of an Environmental Assessment. The County has a limited timeframe for enabling the purchase of this property with respect to its current ownership situation that is favorable to the creation of a public beach park site and the failure to act expediently on this opportunity would result in conditions unfavorable to the County given the current real-estate market situation in West Hawaii. Due to this time constraint, the Department of Parks and Recreation respectfully requests a waiver from the Finance Committee and to have this bill heard at the Council meeting scheduled for July 7, 2005. <3~IIto~ Comm. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): Council action is required to create a new appropriation to fund acquisition of the property found at (3)7-5-18:020, commonly known as "Honl's Beach", that is currently owned by So-Bay Hawaii, Inc. On February 20, 2003 the County Council passed Ordinance 03-18 that rezoned the property at TMK (3)7-5-18:008 (18.946 acres) from RS-10 to RM-4. As one of the many conditions exacted against developer SunStone Realty Partners X, L.L.C., the construction of a public comfort station and 20 public parking stalls were required by Condition E(5) for the County along Alii Drive situated on the County's Sewer Pump Station parcel found at TMK (3)7-5-18:088. A second condition, E(6), requires the developer to construct amid-block crosswalk across Alii Drive to facilitate access from the new parking and comfort station on the mauka side of the road to Waiaha Bay. Currently, Waiaha Bay is accessible (legally) via public access through the Kona Reef Condominium's property to the North off Kahakai Road. There is no public access to the bay south of the property. Regardless of the existing public access locations, there is no agreement in place that affords public access to Honl's Beach or that permits public use of the beach. The property also contains two older residential structures from the 1950's with a small swimming pool that must be removed to ensure public safety and maximize recreational use.
