Higa, Chairman and Members of the Hawaii County Council - Hawai'i County Council 25 Aupuni Street Hilo, Hawaii 96720 Re: Resolution Transferring Funds Enclosed is a resolution transferring $54,672 out and from the Clerk-Council Services - Contingency Relief account and crediting it 4o the Police Department's Administrative Services Salaries and Wages account. At the County Council meeting held on June 1, 2005, funding for this Police Sergeant position (#2820) was removed from the Police Department's budget and placed into the Contingency Relief account. The Police Department has had a Police Officer III temporarily assigned to Position #2820 as the Administrative Division Safety Officer since December 1, 2004. In order to continue with their safety program, the Police Department is requesting that funds be transferred back into their account. As previously instructed by Council Vice Chair Virginia Isbell, we would like to request a waiver from the Finance Committee and have this resolution heard at the Council meeting scheduled for July 7, 2005. As mentioned in previous Council meetings, the Department is asking that the Finance Committee be waived. B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): The Police Department has had a PO III temporarily assigned to Position #2820 Administrative Division Safety Officer since December 1, 2004. Position #2820 has been unfunded in the budget for Fiscal Year 2005-06. It is the Department's understanding that an employee cannot be Temporarily Assigned (TA) to an unfunded position. The Department is requesting that the $54,672 for Position #2820 Police (Safety) Sergeant be transferred from the Council Contingency Relief Account to the Department's Account 010.201.5203.51.011 Admin Serv S&W -Regular S&W, in order that the Department's operations will not be adversely affected. As stated in the Department's letter ro you dated May 26, 2005, Police Officer [II, Michael Riviera, is currently on Temporary Assignment to this position and has been since December 1, 2004. It is the Department's understanding that an individual cannot he Temporarily Assigned to an unfundf;d position, and, thus, beginning July 1, 2005, the duties associated with this position would not be fulfilled, impacting the Department's safety program. Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council, of the County of Hawaii, this written request is submitted with my approval that the above referenced matter be waived from the Committee on Finance to the full council for immediate action. In reviewing this matter, timely approval is crucial It is therefore advantageous that approval is granted and the matter placed onto the next Council agenda for review.
