HomeMy WebLinkAboutRES 125 Draft 01 2004-2006 / V pF tif~l' \YI FED COUNTY OF HAWAII STATE OF HAWAII ,fit p, ~Nr~` nzx RESOLUTION NO.125 U5 RESOLUTION AUTHORIZING THE SALE, TRANSFER OR EXCHANGE, IN FEE SIMPLE, OF LOT 6 OF "CROSSROADS" SITUATE AT LANIHAU 1ST, NORTH KONA, HAWAII, AND THE REPEAL OF RESOLUTION NO. 217-04 WHEREAS, the County of Hawaii is the owner of that certain parcel of land being Lot 6 of "Crossroads," situate at Lanihau 1sr, North Kona, Hawaii, further identified as Tax Map Key (3) 7-5- 04:63; and WHEREAS, Lot 6 is roughly triangular in shape and contains an area of 43,562 square feet, more or less (Exhibit "A"); and WHEREAS, the County of Hawaii does not have plans to utilize Lot 6 for any of its programs; and WHEREAS, on August 4, 2004, the Council adopted Resolution No. 217-04 authorizing the exchange of Lot 6 for a specific property in Kealakekua, South Kona to be utilized as the site of a new police station, and the repeal of Resolution No. 241-00 authorizing the sale of Lot 6; and WHEREAS, the exchange for the Kealakekua site may not materialize; and WHEREAS, the disposition of Lot 6 by sale or exchange would facilitate the acquisition of other parcels of land identified by the County of Hawaii as desirable for public use; and WHEREAS, Section 2-111, Powers of Council, Hawaii County Code, provides, in part, that the Hawaii County Council may, by resolution approved by a majority of its members, direct the Director of Finance to dispose of real property in fee simple by lease, sale or to exchange real property for private property; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that Resolution No. 217-04, which authorized the exchange of Lot 6 for another specific property, is hereby rescinded. BE IT FURTHER RESOLVED through its authority under Section 2-111, Hawaii County Code, that the Director of Finance is authorized to sell at public auction and sell or exchange by negotiation, as long as the public interest demands it, in a manner consistent with Chapter 2, Article 19, Real Property Disposition, Hawaii County Code.
