Dear Council Members,
On May 25, 2005, there was a public meeting in Hilo to discuss and receive input regarding the
addition of a chapter to the Department Rules to address solid waste management plans. One
member of the audience spoke in support of adopting this section. A copy of CHAPTER 6 Solid
Waste Management Plans is enclosed for your review and information.
In an effort to keep you informed regazding matters of our department, 1 am taking this
opportunity to advise you that another public hearing will beheld on July 27, 2005 in Waimea in
order to obtain input from West Hawaii residents. This meeting will begin at 9 a.m. at Tutu's
House, 64-1032 Mamalahoa Hwy, #305, Kamuela, HI 96743.

CHAPTER 6 Solid Waste Management Plans
Section 6.01 -Purpose. The purpose of this section is to provide standards for solid waste
management plans that are prepared by developers to satisfy conditions of any land use approval,
including but not limited to zoning, special permits and land use reclassification. The purpose of the
solid waste management plans themselves is to reduce the impact that new development has on the
county's landfills. These plans should facilitate the diversion of waste through reuse and recycling.
Section 6.02 -Applicability. This section shall apply to any person who is required to prepare a solid
waste management plan or the equivalent as a condition of any land use approval.
Section 6.03 -Requirements of a Solid Waste Management Plan.
(a) A solid waste management plan, based on the anticipated highest potential use of the land given
the land use approval, shall at a minimum:
(1) describe the type and volume of waste anticipated to be generated by the project during
construction and operational phases, including but not limited to greenwaste,
construction and demolition debris, and debris generated from grubbing;
(2) identify the possible sites for waste disposal and recycling;
(3) describe potential impacts to County waste and recycling facilities and appropriate
mitigation measures;
(4) describe how the plan will be implemented, including timeframes; and
(5) state that the applicant, successors and assignees will comply with the plan and
implement it.
(b) A condition of the department's approval of any solid waste management plan is that the applicant,
successors and assignees in fact implement and comply with all components of the plan itself.
(c) A solid waste management plan shall have additional requirements for any project of more than ten
residential, visitor or time share units, if the project includes: common areas; a homeowners'
association, community association or the equivalent; or maintenance fees. A solid waste management
plan shall have additional requirements for any commercial or industrial development. For all such
projects, the solid waste managemenC plan shall also:
(1) identify an area onsite for the source separation of paper, cardboard, aluminum, glass,
metal and greenwaste;
(2) provide for the diversion, reuse or recycling of these resources so that they are not
deposited in the county landfill;
(3) provide that commercial trash haulers will be used to dispose of all solid waste that is
?ot diverted, reused or recycled; and
(4) include any other information or action items that the director deems necessary to
address the solid waste impacts from the development.
(d) The solid waste management plan shall not:
(1) allow for the disposal of commercial solid waste at any transfer station; or
(2) allow for the disposal of construction and demolition waste at any transfer station.
