Higa, Chairman and Members of the Hawaii County Council Hawaii County Council 25 Aupuni Street Hilo, Hawaii 96720 - Re: Amendments to the 1999A and 2001A General Obligation Bond Ordinances On April 18, 2005, the County Council passed an ordinance amending the 1999 A General Obligation Bond (GOB) Ordinance No. 99-41, allowing the use of bond funds for any appropriated projects within the past 3 fiscal years' capital improvement project budget ordinances and without the restriction of having to be listed within the GOB ordinance. Enclosed is a bill for an ordinance to amend the 1999A GOB ordinance (Ordinance 99-41 adopted on April 12, 1999, as amended by Ordinance 00-56 adopted on May 17, 2000, as amended by Ordinance 04-61 adopted on May 27, 2004, and as amended by Ordinance 05-43 adopted on April 18, 2005) to allow the use of remaining 1999A bond funds for capital improvement projects appropriated during FY 2005-06. Also enclosed is a bill for an ordinance to amend the 2001A GOB ordinance (Ordinance 01-33 adopted on March 9, 2001 and as amended by Ordinance 01-72 adopted on August 24, 2001) to also allow the use of remaining 2001 A bond funds for capital improvement projects appropriated during FY 2005-06 as well as for past fiscal years' CIP budget ordinances from FY2002-03 through FY2004-05. Due to the possibility that funding for the purchase of the Honl's Beach Park Property may come from these two bond issuances, we respectfully request a waiver from the Finance Committee and to have these two bills heard at the Council meeting scheduled for August 3, 2005, in order to meet the closing schedule of that purchase. Higa, Chair Hawaii County Council 25 Aupuni Street Hilo, Hawaii 96720 RE: (Bill No. 129 & 130 An Ordinance amending Ordinance No. 99-41 of the County of Hawaii adopted on April 12, 1999, as amended by Ordinance No. 00-56 adopted on May 17, 2000, as amended by Ordinance No. 04-61 adopted on May 27, 2004, as amended by Ordinance No. OS-43 adopted on April 18, 2005, relating to the issuance of general obligation bonds for the purpose ofi financing various public improvements for the County of Hawaii) Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of Hawaii, this written request is submitted with my approval that the above-referenced matter be waived from the Committee on Finance to the full Council for immediate action. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter placed onto the next Council agenda for review. However, in the event this request is denied, for whatever reason, I understand the matter shall be referred to the Committee on Finance for placement on its future agenda.
