ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE NO. 05-87, AS AMENDED,
RELATING TO PUBLIC IMPROVEMENTS AND FINANCING THEREOF
FOR THE FISCAL YEAR JULY 1, 2005 TO JUNE 30, 2006.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Ordinance No. 05-87, as amended, Relating to Public
Improvements and Financing Thereof for the Fiscal Year July 1, 2005 to June 30, 2006,
is hereby amended by establishing the following program appropriations:
PROGRAM AMOUNT
TEA-21 PROJECTS (FEDERAL AID) $3,350,000
LOCAL ROAD IMPROVEMENTS 3,350,000
DOTAL $6,700,000
Allotments from these program appropriations shall be made to be specific projects listed
on the attached Exhibit A.
SECTION 2. Funds for these projects shall be provided from that portion of the
Highway Fund which is designated as the Fuel Tax Increase Account No. 3104.06, and
which consists of the increase fuel tax revenues created pursuant to Resolution Nos.
192-97 and 241-98.
SECTION 3. The current district apportionment formula for the Local Road
Improvement category of the County of Hawaii Fuel Tax Program distributes funds
among the tax map districts according to each district's percent of miles of local streets.
SECTION 4. The proposed district apportionment formula for highway
improvement projects in the Local Road Improvement category will now factor in the
cost of asphalt concrete which varies between East and West Hawaii.
SECTION 5. The Local Road Improvement category revenues shall be
expended based upon an apportionment formula developed by the Department of
Public Works.
SECTION 6. The apportionment formula shall continue to be updated every two
years by submission of a new ordinance by the Department of Public Works.
SECTION 7. If any provision of this ordinance is held invalid, such invalidity shall
not affect other provisions or applications of the ordinance which can be given effect
without the invalid provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 8. This Ordinance shall take effect upon its approval.
