No. 308/Bill No. 1 13 PLACE: Council Chambers TIME: 2:00 p.m. Council Chair and Members I lawai'i County Council I lilo, Hawaii 96720 Your Committee on Planning, to which was referred Communication No. 308 and Bill No. 113, transmitted by Mayor Harry Kim, dated June 8, 2005, regarding a State Land Use Boundary Amendment application by Tooman Family Trust; Marc R. Rice Revocable Living Trust; Patricia P. Rice Revocable Living Trust, at Ouli, South Kohala, Hawaii, TMK: 6-2-9:26 reports as follows: Bill No. 1 13 Becks to amend the State Land Usc District Boundaries Map for the County of Hawai' i, by changing the District Classification for approximately 5312 acres of land from the Agricultural District to Rural District. Communication No. 308 reports the Hawaii County Planning Commission, as required by Chapter 4, Section 6-4.3(C), Hawaii County Charter, considered the above request and accompanying Bill No. 114 on May 20, 2005. The Commission concurred with the Planning Director's favorable recommendation on this matter. Communication No. 308, in synopsis, reports the Planning Director's findings and recommendations as the following: I . The applicants are the owner of the property. "fhe applicants are requesting a State Land Use Boundary Amendment for 5.312 acres from the Agricultural District to the Rural District. 2. The subject property is located along the south side of Kawaihae Road with access from Kanehoa Street, Kanehoa 1?states Subdivision, Ouli, South Kohala. I Iawai'i. 3. "fhe applicants are also requesting a concurrent Change of Zone (Bill 114) from the Agricultural 5-acre (A-Sa) to the Residential and Agricultural 2-acre (RA-2a) zoned district. 4. The applicants are requesting the State Land Use Boundary Amendment and the Change ofL,one so that they may further subdivide the property into two residential/agricultural lots. 5. The subject property was pa~K of the original 27-lot Kanehoa I?states Subdivision that was created in 1985. 6. The approval of the reclassification from the State Land Use Agricultural District to the Rural District will not be violative of Section 205-2. Chapter 205, Hawaii Revised Statutes, nor will it be inconsistent with the Land Use Commission Rules, Rule 13 of the Planning Commission Rules of Practice and Procedures, the Hawaii County General Plan and the Hawai` i State Plan based on the following: • According to the I lawai'i Land Use Commission Rules, the following three standards shall apply when determining an area for the Rural district boundaries: I . Areas consisting of small farms; provided that the areas aced not be included in this district if their inclusion will alter the general characteristics of the areas; PC REPORT NO. ~9 Communication 308 Bill 113 Page 2 2. Activities or uses as characterized by low-density residential lots of not less then one-half acre and a density of not more than one single-family dwelling, per one-half acre in areas where "city-like" concentration of people, structures, streets, and urban level of services are absent, and where small farms are intermixed with the low-density residential lots; and 3. Generally, parcels of land not more than five acres; provided it may include other parcels of land which are surrounded by, or contiguous to this district, are not suited to low-density residential uses for small farm or agricultural uses. • "fhe request conforms to both the Land Use Commission Rules and the Hawaii State Plan. Land Use Commission Rules encourage compatible and low-density residential uses with a minimum lot size of one-half acre, except as provided by County ordinance pursuant to Section 46-4(c), Hawai`i Revised Statutes. • The action also complements the Land Usc and Housing elements of the General Plan by providing additional rural and residential-agricultural housing opportunities in designated areas. • "fhe Rural classification is not expected to have a significant adverse impact on agriculture activities, to traditional, customary Hawaiian rights or resources, nor is it adjacent to the shoreline. Your Committee concurs with the Planning Commission and the Planning Director's favorable recommendation for approval of the State Land Use Qoundary Amendment.
