FUNDS TO ACQUIRE HONL'S BEACH AT ,
WAIAHA, NORTH KONA, HAWAII
Dear Mr. Higa and
Members of the County Council:
When discussioz!s arose for the acquisition of what is known as
"Honl's Beach" by a land trust, the County or other entity, I was asked
whether the parties whom I represent in two civil proceedings would
withdraw their suits in order to remove any clouds over the land. The
answer to the question was and remains "yes."
My clients' interests have always been to preserve and to
prctect the public's interest in the beach at Waiaha, North Kona and,
therefore, my clients will take whatever action necessary to facilitate
t?~c acquioit ion.
For your information, the two civil proceedings involve (1)
the SMA permit issued to SoBay Hawaii, Inc. and (2) a request to
determine the extent of the public's ownership of the land in question.
In closing, my clients are willing to withdraw their suits to
allow the acquisition to proceed. I am sure the other parties (the
County, the State DLNR and SoBay) will also agree to the same. Thank
you.
