To: Ref, Date }3awai'i County is an equal oppor4mity provider .uid employer Memorandum of Agreement For FY 2005 Department of Homeland Security Grant Program Program: Emergency Management Performance Grant SUBGRANTEE: Hawaii County Civil Defense Agency ARTICLE I -PROGRAM DESCRIPTION The FY 2005 Emergency Management Preparedness Grant (EMPG) in the amount of $111,224.00 is provided to Hawaii County. These grant funds are provided to the Hawaii County Civil Defense Agency to support comprehensive emergency management and improvements in mitigation, preparedness, response, and recovery capabilities for all hazards to include managing the consequences of acts of terrorism. ARTICLE II -AUTHORITIES Both State Civil Defense and Hawaii County Civil Defense Agency shall follow the guidance listed in the Catalog of Federal Domestic Assistance (CFDA) "O~ce for Oomestic Preparedness Fisca/ Year 2005 Homeland Security Grant Program': Specific guidance is: 28 C.F.R. part 67, Government-wide Debarment and Suspension (Nonprocuremenh; 28 C.F.R part 69, New Restrictions on Lobbing, and 28 C.F.R part 83, Government-wide Requirements for Drug-Free Workp/ace (Grants). The CFDA number for FY 2005 Homeland Security Grant is 97.067. ARTICLE III -PERIOD OF PERFORMANCE The Period of Performance shall be thirty (30) months from the effective date of the grant award: October 1, 2004 through March 31, 2007. Hawaii County Civil Defense Agency shall not incur costs or obligate funds for any purpose pertaining to the operation of the project, program, or activities beyond the expiration date of the period of performance. ARTICLE IV -AMOUNT AWARDED AND DISTRIBUTION This Memorandum of Agreement for the FY 2005 Emergency Management Performance Grant funds supports the City and County to structure the emergency management programs based on identified needs and priorities for strengthening capabilities that address all hazards. The Emergency Management Performance Grant program funds shall be used for emergency management programs to accomplish the following initiatives: 1. Emergency Management Organization Program. Programs must continue to fund necessary aspects of the emergency management that support day-to-day preparedness, response, and recovery activities, including mitigation. 2. Homeland Security Assessment and Strategy Integration. Ensure that the Emergency Management Performance Grant strategic goals, objectives, operational capabilities and resource E mergeney Management Performance Grant Program Articles requirements are integrated with the homeland security planning - Implementation Strategy for Hawaii Homeland Security and the Urban Area Security Initiative Homeland Security Plan. 3. National Response Plan (NRP) and the National Incident Management System (NIMS). Emergency management programs must update and/or modify operational plans, training, and exercise activities to achieve conformance with the NRP and NIMS implementation guidelines. 4. Emergency Management Accreditation Program. Emergency management programs should take steps to move toward compliance with EMAP standards. The Emergency Management Performance Grant funds can be used to support salaries travel; equipment; operating expenses; and contractor/consultants. Attachment 1 provides the authorized program expenditures for the Emergency Management Performance Grant funds Hawaii County Civil Defense Agency is not permitted to sub grant funds to another county agencies. ARTICLE V -COST-SHARE/MATCH There is 50-60 match required for these grant funds. If costs exceed the maximum amount of funding, Hawaii County Civil Defense Agenty shall pay the costs in excess of the approved budget allow State to use the excess as part of State match. ARTICLE VI -MAINTENANCE OF EFFORT(SUPPLANTING OF FUND The purpose of these funds is to support Hawaii County Civil Defense Agency emergency management programs and shall be used to supplement and shall not be used to supplant county funds dedicated to this effort. ARTICLE VII -ADMINISTRATIVE COST RESTRICTION The Emergency Management Pertormance Grant funds cannot be transferred between the Homeland Security Grant Program funds, Law Enforcement Terrorism Prevention Program or Citizen Corps Program ARTICLE VIII -REQUEST FOR ADVANCE The Emergency Management Performance Grant will be made available to the Hawaii County Civil Defense Agency on a reimbursement basis. Upon receipt of the grant funds, Hawaii County Civil Defense Agency is required to prepare an Operational Expenditure Plan that identifies when funds are expected to be expended. Reimbursement of funds will be made payable by check to the Hawaii County Civil Defense Agency provided appropriate documentation of payments made are submitted to State Civil Defense. ARTICLE IX -FINANCIAL REPORTS FINANCIAL STATUS REPORT: State Civlll Defense shall submit financial reports (Financial State Report (SF-269) to the Office of the Comptrolle4 within 45 days after end of each quarter. Reports are due February 15, May 15, August 15, and November 15. Final financial reports are due 90 days after the close of the grant. Emergency Management Performance Grant Program Articles Semi-annual biannual strategy implementation reports are due to the Office for Domestic Preparedness on the last day of the month following the quarter. Changes in the distribution of funds shall be reported. Haevaii County Civil Defense Agency shall provide a status report to State Civil Defense on a quarterly basis so as to allow compliance with the Office for Domestic Preparedness reporting requirements. REPORT SUBMISSION: Hawaii County Civil Defense Agency shall submit quarterly reports to State Civil Defense, Attn: State Civil Defense by the 5"' day of the month follovaing the ending of each quarter. Hawaii County Civil Defense Agency is required to submit an EMPG annual budget and program (a format will be provided under separate cover). APPROVED/DISAPPROVED: ROBERT G. F.
