RESOLUTION NO. 14'~ 05
RESOLUTION AUTHORIZING THE EXCHANGE OF REAL PROPERTY WITH
DOROTHY L.H. LIU, TAX MAP KEYS: (3)2-4-063:122 (PORTION), AND
2-4-063:130 (PORTION).
WHEREAS, Dorothy L.H. Liu is the owner of real property at Waiakea, South
Hilo, Island, County and State of Hawaii, identified as Tax Map Key: (3)2-4-063:122;
and
WHEREAS, the County of Hawaii is the owner of real property at Waiakea,
South Hilo, Island, County and State of Hawaii, identified as Tax Map
Key: (3)2-4-063:130 (Kawailani flood channel), which borders Dorothy Liu's property
on the mauka side; and
WHEREAS, as part of the Kawailani Street Bridge Replacement Project, the
County needs to acquire ten feet of frontage along Kawailani Street, along with a
two-foot slope easement, from Dorothy Liu; and
WHEREAS, Dorothy Liu has agreed to exchange Lot 41-B (339 square feet),
a 10-foot wide strip, along with Slope Easement "A" (75 square feet), abutting the
entire length of her property along Kawailani Street, for Lot 5-A (976 square feet), a
triangular-shaped remaining property on the mauka side of Dorothy Liu's property
(see attached); and
WHEREAS, Section 2-111 of the Hawaii County Code permits the exchange
of real property for private property, and Section 2-118, Hawaii County Code, allows
for the disposal of remnant parcels.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII, in accordance with Sections 2-111 and 2-118, the Hawaii
County Code, the County of Hawaii accepts the exchange of Lot 41-B (339 square
feet), along with Slope Easement "A" (75 square feet), being portions of Tax Map
Key: (3)2-4-063:122, from Dorothy L.H. Liu, in exchange for the remnant parcel
identified as Lot 5-A (976 square feet), being a portion of Tax Map
Key: (3)2-4-063-130.
13E IT FURI"HER RESOLVED that a copy of this resolution be forwarded
to: (1) Mayor Harry Kim; (2) the Department of Public Works; (3) Assistant
Corporation Counsel Gerald Takase; and (4) Dorothy L.H. Liu, 1034 Ulana Place,
Hilo, Hawaii 96720.
