Tyler III [jct3kona@hawaii.rr.com] Sent: Wednesday, August 03, 2005 7:44 AM To: County Council Tx Subject: Bill 71, Draft 2, Building Code Revisions Aloha Mr_ Chairman and Members of the Council, I ask that you amend the subject draft to allow retaining walls of 6'-0" or less to be built without a permit and without the need for a design and stamp by a professional architect or engineer. I believe these amendments would be to paragraph (16) near the top of page 13 and to the fifth paragraph from the bottom of page 15. For a number of years, the department has allowed retaining walls of 6'-0" or less to be built without a permit or stamp, and, as far as I know, no problems or safety hazards have resulted. The proposal to reduce this height will not only increase the costs to homeowners and businesses, but also the workload for the plan reviewers, which are already over loaded here in West Hawaii. I am unaware of any call for this reduction in height and increase in bureaucracy by either the general public or the professional architects or engineers. To my way of thinking, I don't understand why a solution is being proposed for a problem that doesn't exist. Accordingly, I respectfully ask that you amend Draft 2 before first reading as suggested above. It's hard enough to get a building permit without further compounding the situation. Finally, If you have not already done so, I urge you to carefully consider the three concerns expressed by Mr. Terry Cisco AIA when this draft was reviewed in committee on May 31. To the extent his concerns have not been met, I also respectfully ask that you consider doing so before you vote on the first reading of this bill.
